An off-duty Los Angeles police officer will not be charged for fatally shooting a mentally ill man who had attacked him and his young son from behind in a California Costco, prosecutors said Wednesday.

In announcing a grand jury's findings, Riverside County District Attorney Mike Hestrin said Officer Salvador Sanchez believed he had been shot in the head and a shooter was on the loose when he and his son were knocked to the ground in the unprovoked assault.

Hestrin said his office would not bring its own charges against Sanchez in the wake of the grand jury decision.

Nobody's quicker than Salvador Sanchez!

That was true in the earlier 1980s as well with another Salvador Sanchez. Probably the greatest Mexican featherweight boxer of all-time. That's pretty high cotton.

I'm happy for today's Salvador Sanchez. He had reason to believe that lethal force was justified.

Surprise attacks on you allow for disparity of force responses. Remember that.

...

That’s the first time I’ve seen that he thought he was shot in the back of the head.

From another article:

Hestrin said the incident happened “very fast,” with Sanchez firing less than four seconds after he was struck. The officer believed he had been shot and that he was firing at an active shooter, officials said during a Wednesday press conference, citing witnesses who heard him say he had been shot and saw him reach to the back of his head multiple times to look for blood.

Pretty messed up the guy (in the striped shirt) who attacked the off-duty police officer is being pulled away by a family member and then he gets his head blown off.

At my police academy (1977), the instructor made clear SCOTUS affirmed physical size is an affirmative defense to use deadly forces. Makes sense, 350 muscle-bound thug attacks an innocent person then the smaller guy can use physical force (deadly force).

It is unreasonable to say you can’t use deadly force against someone who has weight/muscle advantages, or attacks you using a surprise physical assault pushing you into a fear of you life situation.

Disparty of force is a well known legal principle.

Except of course, the niggling fact that no bullets hit him in the head. Maybe it was spontaneous combustion?

Rest assured that any one of us "civilians" could fire 10 shots, killing one and wounding two others and get off scot free.

Hestrin notes that French’s parents were uncooperative during the investigation and were heard from for the first time during the grand jury hearing.

People who want to keep their crazies safe should build asylums for them. That’s what asylums were for—not locking up bored housewives (old movie fiction, feminist clucking and psychologist laziness).

Repeat after me:

“One-one thousand, two-one thousand, three-one thousand, four-one thousand.”

Didn’t think four seconds were that long?

If he wasn’t wearing his bright yellow vest stating that he was mentally ill and a danger to society, then the shooting was justified.

So - you would calmly “assess the situation” and if you were wrong, a half-second delay in acting could be your last mistake....but c’est la vie, because it’s the “sensible” way to do things....right?
