No Grand Jury indictment has been returned against McCabe?

Just in: Andrew McCabe’s legal team says in a new letter to Jesse Liu that based on their conversations with the US Attorney’s office in DC yesterday, “it is clear that no indictment has been returned” against McCabe by the grand jury.

doing some research it appears the grand jury was inactive for months then got summoned back yesterday

That makes more sense. Releasing the not indicted letter allows CNN and MSNBC to spread their Fake News with impunity.

If the Grand Jury declined to indicate the letter would have said so.

I doubt a grand jury was ever confronted with this case. Liu ran it to main justice as a courtesy to the "higher ups," givning them dibs on the decline/prosecute decision. The result of that was main justice said the decision was up to Liu.

The sequence this email posits is absurd on its face. Liu get a GJ to say forget it, Liu asks//offers/whatever to main justice, main justice says "try again." Absurd.

No indictment and never will be. Only hope is the Barr, Horowitz, Durham, and Huber report which I have doubts will ever amount to anything. Everything is in limbo and the Republicans don't know how to fight. Talk, talk, talk is all they can do. America is in real trouble.

I wish they would stop announcing these things prematurely. It’s starting to be like the Obama administration where everything is telegraphed before hand. And will someone wake me for the frog march?

People need to relax. There’s not even any reports yet of the GJ even voting yet. The GJ was just called back yesterday and probably haven’t even met yet. Stop believing every report that simply confirms your beliefs and wait for actual facts before claiming Barr is letting us all down or McCabe is getting off Scott free.

Bromwich admits his letter is based on rumors told by “reporters”. But it’s credible because the rumors from “reporters” are in the NYT and WAPO — you know, the publications the swamp uses to plant leaks and lies like the ones McCabe is in trouble for.

Bromwich is trying to push a rope. The proper answer is for a SWAT team to arrive at McCabe’s house at 3am tomorrow and haul him away in jammies and chains. He can live report it himself on CNN.

Nobody at DOJ wants to successfully prosecute criminal Democrats to the benefit of Donald J. Trump. That is as a sure a beltway career ender as there is. So we get this ridiculous years long bureaucratic game of hot potato there.

Grand Jury proceedings are by law secret per Federal Rule of Criminal Procedure 6(e).

Is it ethical for Michael Bromwich, an attorney admitted to the bar and an officer of the court, to be trafficking in purported grand jury leaks?

No doubt true. But now they have competing objectives.

And not to say that this case against McCabe is a good one, setting aside all the other garbage DOJ, et al have been up to.

The DOJ has hemmoraged its credibility. It is a laughingstock. It is despised. It is viewed as a corrupt institution.

It needs a fall guy.

What most people don't understand about grand juries is how they work in terms of evidence presentation and determination of possible guilt.

Evidence is presented only by the prosecution. There is no defense. Jurors only have to reach a "preponderance of the evidence" level of determination, which is far, far less than "beyond a reasonable doubt".

I served on a fed grand jury for a year hearing dozens of cases. Every single one ended in a plurality in agreement to indict. If they present, it's almost a foregone conclusion that there will be an indictment.

You can’t simply move a case like that. Indictments must be filed in the jurisdiction where the crime was committed. There can be a change of venue after an indictment, but only the defendant can request that, not the prosecutor.

The Justice Department’s rejection of the defense’s recent appeal would usually suggest that an indictment was forthcoming. But a grand jury hearing evidence that was recalled on Thursday after months of inactivity left for the day without any sign of an indictment, The Washington Post reported. And as of midday Friday, none had emerged.

Those weasels up in the District of Corruption won’t go after each other. It’s just the opposite. They look out for each other. They only go after the lowly “little people” like you and I. It’s them against us. It always has been. That’s the reason the Founding Fathers gave us the Bill of Rights. We need to start using them instead of always going to the black-robed eggheads on the “courts” and asking THEM to tell us what the Bill of Rights mean. WE are supposed to be telling them what they mean. The Bill of Rights belong to us, not the government.
