Authorities Suspect Gun Used in Midland Was Illegally Made and Sold

Law enforcement authorities believe the gun used in Saturday’s Midland-Odessa shooting was illegally made and illegally sold from a man in Lubbock, Texas.

The Wall Street Journal (WSJ) reported that authorities have “a person of interest” they believe may have made the gun at his home before selling it to the gunman who opened fire on August 31.

It is legal to piece together a gun at home for personal use in numerous states around the country, but it is illegal to sell that gun.

So, since I haven't pieced one together at home, can someone who knows about TX laws tell us, was it legal to assemble and keep in TX? Usually AWR is on top of this but this seems contradictory to me. More like legally made but illegally sold? Anyone?

If you manufacture an 80% lower and assemble it as a weapon you cannot transfer it to anyone. Period. Thats Federal law.

It’s Federally legal, unless otherwise restricted by state law, to manufacture a semi-auto firearm. Texas has no laws restricting manufacture of a firearm other than you can’t make an improvised firearm out of non-firearm parts.

Federal laws *do* say you can’t make the firearm for sale or distribution, but you can sell it, give it away, etc. later on if the thing was originally intended only for personal use. If you transfer it, you have to put a serial number on it even though you need not put one on at time of manufacture.

CRUDE guns are easy to make at home. I have an old article about prisoners behind prison walls making full auto machine guns. Even the cases and magazines were cobbled together in prison.

Anyone remember the old FIREPOWER magazine from the 1980s which showed hot to do such things, and who can forget the ANARCHIST’S COOKBOOK.

See my link above. Yes, you can, but it may not be a good idea and you certainly can’t hand it over to someone else immediately upon assembly.

This is, apparently, an 80% receiver that was finished out, and then assembled into a firearm. Perfectly legal in TX and many other states.

Federally, you are strongly encouraged to add a serial number of some type, so that the gun can be traced if stolen. Selling it without a manufacturers license from the BATFE will net you a bunch of prison time and some big legal bills.

I can’t help but think that this incident will be used to restrict/eliminate the right to manufacture one’s own firearms. The antis are scared $hitless by the entire concept of untraceable 80% receivers (otherwise known as “paperweights.”

Of course, there’s always the possibility that this was pre-planned to include an 80% receiver, but whether that occurred or not isn’t that important - that “they” are going to be coming for the self-manufacturing of firearms is something that we have to prepare for ASAP.

Exactly. It can be legally made from an 80% lower for personal use only, and then probably illegally sold to the insane POS. And that’s the person who needs to be prosecuted, not the rest of us. IF it was a fully finished lower, it was considered a firearm at the time of sale and went thru the system just like any other completed firearm.
I believe Post #3 is correct. IF the firearm has no serial# or even a crudely stenciled one, the stupid SOB that built and sold it to him should be the one prosecuted. There are Federal requirements in regards to exactly how the serial# is supposed to be as well.

One obviously needs the uncompleted lower to start with.
Then, one would also need to purchase the proper high quality jig (probably good for 3-4 jobs depending on one’s skill level), the machining bits and a good drill. Then, depending on one’s time and skill level, it can be machined out. I’ve seen some really rough, crude-looking ones that looked like a 5-year old did it, but hey....they worked. IF one had a small milling machine and knew how to skillfully operate it, an 80% can be turned out that looks pretty darn decent. In the end, it’s more expensive than just buying a completed lower, BUT one doesn’t have to go thru the transfer paperwork. However, it’s for PERSONAL USE ONLY. Anything outside of that is either illegal or a real PIA to legally do since one has now become a firearms manufacturer.
Personally, I find it’s just a PITA to do. I’d just purchase a completed lower and be done with it, but it can be done.

In this shooting, as in most of the others, something ILLEGAL was violated... simply stated: existing laws were broken... yet the LIBERAL LEFT insists we need MORE laws in order to control "gun violence."

How about simply ENFORCING THE DAMN LAWS THAT ALREADY EXIST!
