Bernie Sanders calls for doubling union membership, scrapping ‘right to work’ laws

Sanders, who is making his second straight bid for the Democratic presidential nomination, vowed “that war will come to an end when I am president. If we are serious about rebuilding the middle class in America, we have got to rebuild, strengthen and expand the trade union movement in America.”

Sanders said if elected, he would aim to double union membership by the end of his first term in the White House in January 2025. His plan also calls for ending so-called "right to work" laws favored by Republicans and decried by organized labor for weakening a union’s ability to negotiate contracts.

Twenty-seven states currently have such laws, which prevent unions from insisting workers become union members as a work requirement.

Sanders’ proposal would also give every union worker the right to strike and ban the replacement of striking workers. And the progressive senator also pledged to sign an executive order to prevent large corporations from engaging in union-busting and outsourcing jobs, while preventing companies that pay workers less than $15 per hour from obtaining federal contracts.

Labor unions are a state power issue, not any concern of the feds imo.

In other words, misguided, post-17th Amendment ratification Sen. Sanders needs to get out of the constitutionally limited power federal government and try to get himself elected to a state government office.

If he can do that, then he can use 10th Amendment-protected state powers to experiment with labor unions as the Founding States had intended.

Note that the congressional record shows that Rep. John Bingham, a constitutional lawmaker, had put it this way about state power to care for the people.

”... the care of the property, the liberty, and the life of the citizen, under the solemn sanction of an oath imposed by your Federal Constitution, is in the States, and not in the Federal Government [emphases added].” —Rep. John Bingham, Congressional Globe, 1866. (See about middle of 3rd column.)


Justice Brandeis had reflected on Bingham’s words, putting it this way about state powers.

"It is one of the happy incidents of the federal system that a single courageous State may, if its citizens choose [emphasis added], serve as a laboratory; and try novel social and economic experiments without risk to the rest of the country.” —Justice Brandeis, Laboratories of democracy.

Note that constitutional limits on states as laboratories of democracy is that states cannot establish privileged / protected classes or abridge constitutionally enumerated rights, and must maintain a constitutionally guaranteed republican form of government.

Every American has THE right to work without being forced into becoming a union member or paying union dues.

There was a time in America - late 1800s and early 1900s - when unions were a net positive to the American worker and economy.

That time passed long ago!

Right to Work states are performing better in an economic sense than are non-Right to Work states.
