Trump reshapes long-liberal 9th Circuit, as Republican-appointed judges gain seats on court

For the first time in more than three decades, Republican-appointed judges will soon occupy nearly half the seats on the left-leaning 9th Circuit Court of Appeals -- dealing a setback to progressive legal advocates who have long seen the court as a safe bet for favorable rulings.

The radical transformation of the San Francisco-based court is largely the result of President Trump's aggressive push to nominate conservative judges and bypass traditional consultations with Senate Democrats -- a practice that has led to repeated howls of protest from California's two Democratic senators, Kamala Harris and Judiciary Committee ranking member Dianne Feinstein. The 9th Circuit has a sprawling purview over cases arising in nine western states, including California, Hawaii, and Oregon.

Once Trump's latest picks to the 9th Circuit, including Ken Lee and Dan Collins, are confirmed as expected and remaining vacancies are filled, 13 of the 29 active seats on the key appellate court will be filled with judges picked by Republican presidents. At this time last year, 16 judges on the 9th Circuit were appointed by Democrats, with only six chosen by Republicans.

The 9th should be broken up into at least 3 separate ones.

A Little drill down in the District Courts of the 9th Circuit

Alaska 7 Seats, 1 vacant, 6 Republican appointed
Arizona 13 seats 3 vacant, 7 Obama appointed 3 Bush/Trump
Central California 28 seats, 8 vacant, 9 Obama, 11 R appointed
Eastern California 6 seats 3 Obama 3 Bush
Northern California 14 seats 11 Obama 2 Clinton 1 Bush
Southern California 13 seats 5 vacant 4 Bush 4 Obama
Hawaii 4 seats 2 R 2 D
Idaho 2 seats 1R 1D
Montana 3 Seats all Obama
Nevada 7 seats 2 vacant 5 Obama
Oregon 6 seats 1 vacant 4D 1R
Eastern Washington 4 seats all Obama
Western Washington 7 seats 4 vacant 3 Bush

Pretty clear some of these are skewed far towards Democratic appointed judges: Arizona, Northern California, Montana, Nevada, Oregon, Eastern Washington.
Arizona will be almost even with appointments for the open seats, the others in the above list appear locked left for the foreseeable future.

Still a long way to go, but at least our odds for a favorable 3-Judge panel will be better. If reelected, Trump will be able to tilt the court back to a neutral balance. Unfortunately, with GW Bush allowing the Dems decide what was acceptable, some of the 5 remaining Judges he appointed are NOT conservative, and we need to offset them with more appointments. Splitting the 9th would accomplish that.

What? How did that happen? A ‘bush’ being suckered or out played by a Democrat? It appears that it happened all of the time.

The next thing that needs to happen is for that Circuit court to be cut down to size. It is far too big, affecting way too many states and people.
