The Second Amendment in the States

United States – -(AmmoLand.com)- Much of the focus on Second Amendment issues tends to be at the federal level. There are good reasons for this focus: Federal law sets the baseline for laws affecting our Second Amendment rights. Federal judges can overturn anti-Second Amendment state laws. The President can appoint new federal judges, and also can set the tone for what happens in the executive branch.

We have been very fortunate to have President Donald Trump these last two years. Some may nitpick about the bump-stock ban via the regulatory process, but that is far better than the legislation anti-Second Amendment extremists have wanted. As Duane Liptak pointed out in January, sometimes, the best that can be done in a given situation is to limit the damage. Trump’s judicial appointments, though, including those in the 9th Circuit, will be a massive shift over the medium to long term.

Those judges offer us a far better chance to strike down semi-auto bans, among other restrictions that are clearly in violation of the Second Amendment than those we would have gotten from Hillary Clinton, or those we could get from a Kamala Harris or Bernie Sanders. But the states are also an important battleground, for three reasons.

I thought this was timely in light of potential SCOTUS review of concealed carry. As I wrote on that thread, I am NOT confident that SCOTUS today would rule correctly and, if we lose in a 5-4 ruling with a ghastly anti-carry opinion written by Roberts, then those states with strong concealed carry protections MAY be in jeopardy.

I feel for my brethren Deplorables in blue "may issue" states. But I would borrow from MacArthur and opt for delaying a full assault on the main target with heavy losses and go for massive strokes against only main strategic objectives, utilizing surprise and air-ground striking power supported and assisted by the fleet. I would rather suffer the sporadic injustices of "may issue" statism when there ARE many surrounding states that permit freedom (and where state level activism should be pursued, vigorously), than gamble and lose at the federal/SCOTUS level unless we get two liberal retirements and good replacements.

Battles are fought at multiple levels. federal, state, marketplace , and many more.

I agree. In NJ there are many good Deplorables that, from time to time, get tiny firearm wins though they are few and far between. Further, while NJ is awful on handguns and "assault rifles" and transportation, it is surprisingly good on ammo (though you gotta be careful with hollow points) and long rifles.

It also, strikingly, has probably the BEST homeschooling laws in the nation, which has been sustained by vigorous defense via rabid HSers (and I mean that with love). If both groups could team up it could be potent (though I suspect the overlap may be big).

Battles are fought on many fronts. There were a lot of factions that our Founding Fathers had to deal with.

If I read history, a third were pro British, a third wanted freedom for various reasons, and a third didn’t care.

There is much to learn from history, that is why the left wants to destroy it.

But the major lesson is never give up. Keep probing the perimeter for their weak point. Never Trumpers complain that Trump hasn’t delivered on the wall. But notice all, he has never given up on the objective, keeps probing and is advancing.....................

Anyone who is indifferent to gun control needs to look at Venezuela! The government took away their guns, several years ago.

Now, if they are going to fight, they need to disarm the army to get the means to recover their freedom.

I have been tempted for years buying a handgun in NJ being born and raised in 2A friendly PA. Many may be surprised that there are many gun ranges and places to buy ammo but the BS to go through to utilize my Constitutional right of the Second Amendment is disgusting here in Socialist NJ. I will just wait to move to a 2A and overall Conservative state.

On the plain wording of the 2Amd the States have no say re guns or other Arms. Ditto the Federal Government. The 2Amd is absolute. Any and every law or rule that modifies the RKBA is unConstitutional.

The government will probably make the definitive effort against guns soon after the 2020 election which the Democrats will win. We cannot counter the level of vote fraud that will be employed. The level was raised high in the last two elections and was pretty open. The Democrats know there is no penalty and the vote count in Democrat precincts i.e. all the larger cities, will swamp the system. The Democrats are at a point where they can openly manufacture millions of votes and include them in the count, or just claim whatever number they want and because individual votes cannot be separated out they will be all of them accepted and the counts will all stand. The lack of penalty in 16 an 18 combined with the new SocDem majority in the House guarantees that 2020 will be a Social Democrat “blowout.”
