President Trump said on Friday that he "didn't need to" declare a national emergency but did it to speed up construction of the U.S.-Mexico border wall.
"I want to do it faster. I could do the wall over a longer period of time. I didn't need to do this, but I'd rather do it much faster," Trump said during a press conference at the Rose Garden in the White House.

I take it as Congress failed to act,
and he didn’t have to declare an
emergency if they had. Congress has
shown their resistance to building a
wall, and Trump knows that any future
attempt to pass legislation is a dead
horse. With a emergency declaration, he
gets the wall built faster.
That was not a smart thing to say. He just admitted that he doesn’t really believe there is an emergency. That undermines his declaration. Dumb.

I interpreted that as he could get the money and build it slowly over years, but that the situation required speedier action.

As far as legal challenges:
2) Legal challenges have been ruled extensively on this question. Of course, any court might rule any way it wishes but on the question of the right of POTUS to declare an emergency and redirect funds has been decided in favor of POTUS at the USSC decades ago.
3) Emminent domain challenges are unlikely to hold up - the USSC passed a really crappy ruling allowing government to take just about any land at any time for any reason. Those who wish to challenge land takings will first need to exhaust their administrative options before a case will be come 'ripe' (allowed into court); and then very likely to fail. The only question is compensation.
But POTUS is also imo missing an opportunity to make his personal. He lost his brother to substance abuse. Personally I think this is what is motivating him more than anything... not some made up 'hatred for hispanics' but the desire to make up for the loss of his brother. He should put this out in front. He did during the campaign, he should remind the American people why he needs to do this.

He could say he was thinking about the funding bill. With the 1.35B of extra funding, he could do it faster.
I don’t think the guarantees he loses anything. There is no authority to second guess his Executive Privilege. Congress gave POTUS this power, there are more than 30 ongoing “emergencies” including one that Obama declared to keep people from terror hotspots on watchlists - which Trump argued to expand with his temporary travel ban.
He just said it was not a national emergency. He just said he’s using the pretense of a national emergency to expedite a non-emergency.
He just gave the democrats a nuclear weapon to undermine his agenda.

I agree. He could day he mis-spoke in the press conference. All you need to do is demonstrate illegal drugs and bad people coming across and I think you might have enough.

Yet again he is saying it isn’t an emergency.
Just like he will now supposedly defend his emergency declaration in court saying it is such an emergency he has to violate the omnibus law—that he just today signed.
a judge will say: this “emergency” existed when you ran for office. It existed for two years while your party was in power, you have a deportation process in place. i find for the state of California and overrule the emergency order. Thanx for the opportunity.
