How Trump can get the rest of his wall money — without a shutdown or emergency

Democrats have agreed to fund $1.375 billion for 55 miles of physical barrier along the border, which is only a little different than what Trump would have gotten under a continuing resolution that funded the government at current levels — and far less than the $5.7 billion Trump demanded to build 230 miles of barriers that experts and the Department of Homeland Security said they need to secure the border.

But Trump can still get the rest of the money — without a government shutdown or declaring a national emergency...

To win, Trump needs to shift the debate to a place where he has real leverage: using the threat of a sequester, rather than a shutdown, to force the Democrats to give him his border barrier. In 10 months’ time, if Congress fails to act, then an automatic sequester will kick in that would reduce federal spending in 2020 to levels that Congress and President Barack Obama set in the Budget Control Act of 2011. Congress agreed to lift those spending caps for two years in 2018, increasing both defense and nondefense discretionary spending above sequester levels by $165 billion and $131 billion, respectively. But that deal runs out at the end of the year. If Congress does not lift the caps by December, then automatic $55 billion across-the-board cuts to domestic discretionary spending will take place, while defense spending will be cut by $71 billion...

The money is only the beginning of the problem.

Congress will pass a law forbidding building a wall. They may very well override a veto. Their donors simply are not going to stand for a wall.

Every foot of wall is going to disturb the migratory pattern of some worm, or squash a butterfly. Every single foot will be the subject of multiple lawsuits.

So cut the military to the bone via re-enacting the Sequester? That’s the “brilliant” idea. Harm the one institution that is most loyal to his administration? The same military that everyone wants to now use to defend our southern border and build the wall? Screw the military, huh? Yeah, what a GREAT PLAN.

I’m not sure what the law is that you cite but I’m guessing it refers to his authority as the Commander in Chief of the Armed Services. If so I totally agree. Or he can use the War on Drugs laws passed by Congress to construct walls to inhibit the flow of drugs a cross the border. Either way he’s on form legal ground with the courts from what I’ve read. And why not use drug money confiscated like El Chapo?

What utter nonsense. This plan isn't in the president's hands at all - it's in the hands of Congress. The sequester can only take place if Congress does not agree to lift the 2011 caps - and does anyone really believe that McConnell and the GOP will not agree to do so? Have we all forgotten that the GOP controlled both houses of Congress for the last two years? Are we all supposed to pretend that McConnell is not pressuring Trump right now to accept the current funding deal which does not give money for the border wall?

This is not a plan at all - it's simply a way to ensure that the Congressional GOP will continue to thwart Trump's campaign promise to build a wall.

IMO the Repub leadership has the smarts of a pigeon.

And in this situation:

I don’t really see the difference. The Dems will still postulate and claim Trump is cutting programs like Social Security etc. And threats to cut the military are not a good thing now. Send it back. Shut it down. Don’t be afraid of these politicians. They have much to lose if they are shown to be betraying American safety.

IF. IF. Let’s see. Who runs Congress? That would be Pelosi and the turtle overseeing a bunch of dems, RINOs and a few decent ones. Under this so-called plan Trump drags this thing out another year, wastes time, Congress votes to lift the caps and Trump — loses — again.

Trump needs to take the $1.3B, dig up the balance from the military, build the wall now and stop d**king around with Congress. In which case he will need all the spare defense money they’ve got. A sequestered defense budget works against him.
