Guess I am seeing this differently then many here. Judge Kennedy has served POTUS up a tremendous softball opportunity to reign in the WH Press Corps. The judge made it clear that this was not a 1A issue. He simply stated that Acosta’s right to due process was violated. What the WH will do, and has already signaled, is to devise a stringent set of rules of decorum.

Expect to see: Reporters will only speak when asking a question, if and when they are chosen, any follow-up will have to be accepted by the speaker prior to being asked, if the speaker moves to another reporter, you will quietly relinquish the mic and return to your seat, etc.

Anyone violating this decorum will have their credentials revoked and due process will no longer be an issue due to a clear set of guidelines being violated. This will effectively neuter the grand-standing taking place now.

This is why CNN is really not celebrating this, but instead reporting that the signaling from the WH in regards to a new set of decorum is “ominous”.

I can see what you’re saying, but what due process is involved? Accosterdoesnt work for the WH. A press press is not a contract, is it? What due process is the judge hanginger his hat on?

Due process to what? Acosta and every other correspondent can have their privilege revoked at will by the Executive Branch. Also, he was not detained, arrested nor prosecuted; there is not a Constitutional right to any of this at all.

The Executive Branch has Constitutional rights (Enumerated in Article II Section 3) to ignore any and all reporters as well as having the right to dictate the decorum along with access to those who exercise a privilege the White House is providing.
