He can put in anyone in the department that has gone through a congressional approval process. This person could act with all the positions powers until he gets someone else through the process, however long that will take.

No it it is not a recess appointment. It’s an Acting appointment with a time limit, based on Whitaker having served for 90 days in an executive role.

I think Trump needs to recess appoint a real bulldog. Someone that Washington, DC will really HATE. And then submit his real nominee to the Senate. Then they can choose. A guy you hate, or a guy you hate more?

OF COURSE it could all be better: genuine MAGA Republicans could be in decisive control of both houses of Congress and could be acting energetically to remove all obstacles to enacting the complete MAGA agenda. Of course that would be better.
But we will have to try to make the best of the current situation, and better control of the Senate was the single most important issue at stake yesterday.

I’ve believed for some time that Sessions was to run DOJ until midterms. That was enough time to ID the worst of the bad apples and remove them, restore morale after Obama turned these agencies into a political weapon, and to buy time for investigations to get started. Trump probably sees it like a building project where a time comes when you bring in a different contractor to finish the work.
