“If only three other Justices wanted to entertain the possibility that the status quo could be reversed, I’d say that doesn’t look good for the states.”

That doesn’t make any sense as Ginsburg, Sotomayer and Kagan will always vote opposite the conservative majority.

And that is why Ginsburg, Sotomayor, and Kagan will not vote to hear the case. They’re happy with this current situation. If I’m reading the article right, at most three of the other five justices were interested in hearing it. The author of the article is raising only a possibility that Kavanaugh would be the fourth.
