If they dont give a damn about getting a conviction, just think being able to use the word felony in a misleading headline was the goal. As weird as it sounds, I also read that attempted rape at the time was not a felony.
The criminality doesn't matter anyway, it is the #metoo infringement which has no statute of limitations and where there is no presumption of innocence. The technicalities that they are trying to get Kav on appear to be perjury about his drinking. Wow, the whole thing becomes a perjury trap just for the "job applicant".
