It's "assigned" by biological processes well before birth, usually at conception. But of course we're not supposed to talk about the child before birth - during that time there is only the pregnant woman and her 'reproductive rights.'

The Jordan Peterson problem can’t happen in the US because our speech is more clearly protected. I can call a person a dummy and my words are protected by law.
I teach English as a Second Language, and I know that English is enough of a challenge for most people (even some native speakers) that I won’t be teaching any made-up pronouns or possessive adjectives. I owe that to my students and to myself as a professional and as a custodian and lover of my language.
The sexually-confused are not even consistent themselves in how they use the pronouns. A kid in my son’s high school class graduated in a dress and high heels. He is very effeminate, but it is obvious to everyone that he is a male. Sometimes he dresses as kind of a fruity male. Evidently he plans to get the surgery done. He still uses his birth name and is referred to by “he” and “his.” I also had a student some years back who I thought was female but answered to a male name when I called the roll for the first time. After a moment of cognitive dissonance, I realized that “she” was a he and I always referred to him as such.

In order to safeguard my mental health and not feel mentally sexually abused by those in society who are mentally confused and not be mentally sexually abused also by those that support their mental sexual abuse of us, a member of the reality based society, I will continue to use language as it corresponds with the assignment of sex/gender by nature as the will of God, therefore protecting myself from sever psychological damage by someone whose sense of reality does not match with the physicality of reality. My right to save my mental health and the right of society to maintain good mental health begin with REALITY not entry into the Mental Sexual Fantasy of what a deluded group of people mentally dissonantly fantasize life should be.
