The prosecution is under an ongoing court order to produce any evidence that might weigh into any consideration of Flynn's sentencing or even his guilt. That second part is an unusual one, since the court order was signed AFTER Flynn's plea deal was announced.

The Nunes/HPSCI memo contained references to information that was never used in Mueller's investigation (I would assume this was the case because FISA surveillance materials would almost certainly be considered inadmissible in court), but may have huge ramifications for Flynn's sentencing or even his guilt.

Flynn probably now has all the legal standing he needs to get his hands on any FISA warrants, surveillance materials, etc. related to him.

His legal team might even serve the subpoena on the House intelligence committee in addition to Mueller.

I'm sure Rep. Nunes would be all to happy to comply with any demands for documents related to the FISA surveillance of Trump campaign team members.

Hey thanks. Can you point me to the ongoing court order ? That would definitely seem to circumvent the weasel words in the plea deal.
