I don’t believe so. Not unless the charges are modified. The last time I was exposed to the UCMJ was in the late 80’s so it may have changed since then. However at that time there were really only two charges that would garner the death penalty - murder and treason. Desertion could get you a life sentence but not the death penalty. I know that the code SAYS desertion in time of war can be death penalty. However no official declaration of war existed so that is a gray area.
I would have to defer to those with more current experience with UCMJ.
Your comments paralleled what I thought to be the case. Actually, getting a life sentence w/o parole would be a lot harder than being put to death in my view. The only thing I was considering was that fact that it has been reported that some of his comrades in arms died looking for him. But I guess in the strictest sense, that isn’t murder, although they are dead, and he was the proximate cause of their demise.
