Mann shot himself in the foot with that last. For several years, Mann had refused to produce his data for the court (in support of his own case), claiming that it was “proprietary.” After missing a February 20th deadline, he now finds himself in contempt. Under Canadian law, the court is now required to dismiss the suit.
John O'Sullivan goes into detail:

The lawyers for his side....had to know that this would come up, but I doubt if they explained it to him. They were just there to soak up the cost of the case and drag Mann along.
For Mann, it’s an enormous embarrassment. The case just ends...only because there cannot be a data set shown in a court.

My kid once went to one Mann’s lectures, where he rambled and provided no documentation for ANY of his statements, except for a childish hand drawing displayed on an OHP. At the time, my kid had no idea who he was but came away totally unimpressed with him.
Steyn should have some interesting things to say about this turn of events.

Remember those leak East Angelia Climate Center emails where Mann boasted he had found a way to hide the observed decline in global temperatures? The man is a fraud.
The sky may not be falling but it looks like the gavel will.
He refused to provide his back up data while at the University of Virginia.
The hockey stick was a lie. It never came to pass. It’s like talking 20 years later about the devistation in Texas caused by a tropical storm in the gulf that never reached shore but was predicted to be cat. 5...
Amen. Preach brother. I can’t wait until 95% of Americans agree. The brainwashed left will only come to those conclusions kicking and screaming, but the hoax can’t be propped up forever. The truth always wins out in the end ans so it will be with the hoax of anthropogenic global warming.
He is not just defying the Freedom of Information Act, he is also defying accepted scientific practice (by the consensus of scientists). In any respectable science, data cannot be hidden but must be revealed for scientific review.
Except he's not practicing science, he's publishing false propaganda. And his actions in this case, a case that he brought, should prove that to everybody. But it won't. The True Believers will not be shaken from their faith, the publication of the East Anglia emails should have done that years ago.
