I've followed the 9th Circuit for decades, especially when it came to rulings on 2A cases. They have never ruled in favor of the right to keep and bear. This is just par for the course with the 9th Circuit.

All of this court crap was predicated (and planned) because of the death of Justice Scalia. The left wing crazies seized upon the now 4-4 split in the USSC to rapidly push forward lower court cases wherever they could knowing that the 9th rulings would likely stand if the SC decided to hear the cases.

That is what happened in California this past year where 11 very bad gun laws were passed precisely because they knew there was no Scalia on the SC to slap them down. (These tyrannical laws have not yet been appealed to the USSC, but briefs are being prepared - to no avail in my opinion).

The California legislature is hurrying like hell to completely strip the citizens of the state of their 2nd Amendment rights. This crap about usurping the power of the President is just icing on the crooked judicial cake. The F'ers are not going to stop until we stop them.

President Trump better assemble the best legal minds in the country and come up with a plan to slap these bastards down - or I fear for the ultimate outcome.

This was only a temporary restraining order, not a trial on the merits so settle down those of you foaming, concerned we’re going to get locked into ... whatever your fevered minds believe.

The important concern is the unwillingness of a part of the judiciary, a federal circuit court, to give deference to a coequal branch of government. But we all knew it’s the Circus.
Since getting a TRO isn’t that hard—a showing of immediate, irreparable harm—upholding it isn’t that difficult either. The key word is “temporary”.

Any attacks on Americans, though, by disgruntled refugees during the term of the injunction and the judiciary branch are the goats.

So Trump does what we elected him to do, tries to protect Americans with zeal, and he’s acting stupidly. Give me a break. He knows what he’s doing.

His `mistake’ (if any) was thinking, after numerous bloody attacks on us by immigrants and `refugees’ who came here from these countries, that Democrats were as interested in securing the safety of their fellow Americans as they were in jamming a stick in his bike spokes.

You are so right. But first, some food for thought.

Here it is right here. God’s judgment. For 43 years this nation has legally killed millions of its unborn citizens. Why? Because some judges ruled it legal. And a good portion of the citizenry said “ oh okay”. Even me, I repeated the leftist lies for years of incest, rape, blah, blah, blah. Pro abortion politicians for years appointing pro abortion judges. It took me 30 years to open my eyes. Some eyes were open from the start, and some are still blind as bats.

Fact is that it was never legal. Murder is never legal. How could we be so stupid? So, now this judge just sentence born citizens to death. Eyes will be open.

So yes, we need to get off our butts and do something.

"I would not - repeat, NOT - appeal this decision to the USSC, which could - and will - make it fixed law by a 4-4 tie."

I agree unless he can get Neil Gorsuch sworn in and I know the Democrats are going to fight that nail and toe. By that time Presidents Trumps EO would have run out the 90 days and 180 days (I think it was)

I wonder if he rewrites it if it could pass?

There is no penalty for judges who break the law.

Impeachment of a judge notwithstanding, judges have, for a very long time, simply but silently said, “Yeah? So?”

Here is an idea for Freeper sleuths. To find out who is really running the country, find out who is paying for these judges’ security detail. Because you know they need security right now. First guess will automatically be Soros, but any other guesses?

Sessions, you have a job to do, stat.

I do think things are different this time with President Trump. The Congress does seem to be acting like a majority party.

Regarding this matter, it is too plainly partisan. Obamacare was a completely different matter. The SC was siding with the legislative and executive branches. In this case they will do the same, i.e. vote 8-0 for President Trump.

If the SC were to side with Robart, President Trump will simply ignore the TRO and proceed to protect America. The Democrats and their propagandists will squeal, but the voters will side with President Trump. Meanwhile the Democrats are losing momentum, the narrative and voters all the way to 2018.

Don’t doubt President Trump. So much winning!

> III. Standing [] The States argue that the Executive Order causes a concrete and particularized injury to their public universities

The universities of Washington and Minnesota do not suffer a particularized injury. The injury (actual or potential) suffered by universities of Washington and Minnesota are no different from the injuries (actual or potential) suffered by universities of each and all states. The universities of all states - indeed all universities whether state owned or not - suffer identical injuries (actual or potential).

Who asked them ?

They already gave their their opinion? How many are they going to give ? Will they give us another one next week? Which one do they want the Executive Branch to enforce? Could this be why the 9th Circuit gets so many more their decisions overturned than normal courts?

Could be that that write so many opinions on one order, because they are confused as to what the law is, that they confuse the Supreme Court who has to keep sending them back till they tell them which one is the real opinion?

I know. They want to increase their seemingly perpetual lead in the Guinness Book of Records, for having the most wrong and therefore most overturned opinions of all the Circuit Courts.

Maybe they should have gone to the high school where I went 53 yrs.ago. We had to have two non elected credits in P.O.D.( Problems Of Democracy) one 11th grade one in 12th.

You had to pass. It was very interesting and should still be required.

It taught how our Constitutional Government, State and Federal came into being and how each Branch Executive, Legislative And Judicial functioned.

Or they might could just read The Constitution of The United States. If you ask, one of the other branches may have a copy you can borrow, maybe.
