Recount 2016: Jill Stein Cannot File Direct Request For Recount In Pa, Must Take it to Court

Jill Stein posted to her Jill2016 website that she had raised enough money to “file” for a recount in Pennsylvania. However, the Green Party candidate left out some key details about the filing of recounts in Pennsylvania that many of her supporters likely would have wanted to know before donating. For example, candidates cannot file a direct request for a recount in the state and instead must appeal the election in court.

She claimed “data” has suggested a need for recounting “machine-counted” votes in these particular states, which also happen to be states that Trump unexpectedly beat Clinton.

Should all three states be overturned in a recount, Clinton would have enough electorates to win the election. However, Stein did not make the recount process clear for her donors. Her outline makes it sound as though a candidate can simply file for a recount if they raise enough funds for the filing fee.

While the filing fee and request is all that is needed in Wisconsin, her second state “funded” is much more complicated. Pennsylvania does not allow candidates to file a direct request for a recount, according to the Pennsylvania Election Code. Instead, the filing fee is simply the amount needed to appeal the results.

During the appeal process, the court may determine that a recount is necessary.” Per Pennsylvania regulations, there is only one way remaining for Jill Stein to get a recount in Pennsylvania and it is a complicated process. BillyPenn reports that Stein would have to file for a court appeal and present a “prima facie case” showing that voter fraud took place. While prima facie has a lower burden of proof threshold than “beyond reasonable doubt,” it is still significant. Stein would have to prove in court that fraud was “probable.” This is going to be very difficult given that even the computer specialists recommending the recount say there is no proof of hacking or fraud.

However, since Stein has funded and initiated the effort, Elias says that Clinton will participate to ensure fairness.

Stein has maintained that the effort is not designed to overturn the election results, but rather to ensure transparency in the voting process. Stein has even criticized Clinton for joining her efforts so late in the game, calling her “on-again, off-again about democracy.”

There is none other than WI has very loose standards for demanding a recount - I believe that the Clinton Foundation needs to move money out of their foundation before Trump gets in power. I have a strong feeling their ledger is bulging after the election and they need to get rid of some cash any way possible.

Yep. “Prove” in their deranged little lefty minds that Trump was ‘selected not elected’ aka Bush v. Gore by getting a court ruling against themselves, and use it as a bludgeon on him for 4 years to pave the way for Hillary’s third run at this in 2020.

Nope. Has to file with the PA Superior Court. Can’t be a local Court of Common Pleas.

The PA Superior Court appears to have 7 republicans and 7 democrats. Not really sure what to make of it.

Good point. The games afoot at recount officials, in courts soon, by threatening electors, and by bribing electors too. And — she/Soros do not plan to let mr Trump take office -— except I think he’s tougher than even the wicked witch plus the satanic Old Nazi. We will see but it looks very very good the R party chose mr Trump. Nobody else could possibly survive this onslaught of raw evil forces.

Don’t laugh this off, folks. Hopefully, some pro-Trump people will have lawyers sent to counter this suit, should it happen. Because we all know that undoubtedly Clinton campaign members, leftoids, Democrats, GOP-e and/or Nevertrumpers are behind this.

This must not be allowed to succeed.

(Do I want to stomp out voter fraud? Of course. But this attempt has nothing to do with that, IMO. Why not peruse Virginia as well, where Hillary narrowly won, no doubt due in part to McAwful’s hijinks with pardoning 60,000 felons with an autopen? Furthermore, there is no credible evidence of hanky-panky in these states, as far as I know.)

This is highly illegal we expect the Trump campaign to challenge the donations on Monday.

Supreme court clearly defined this practice as illegal and influencing United States elections.

Legally, I don't think she can just put all that money in her pocket.

However, I'm sure she's already figured out how to spend every penny of it on lawyers and salaries for campaign staff (including herself) over the next few weeks.
