Recount 2016: Jill Stein Cannot File Direct Request For Recount In Pa, Must Take it to Court

Jill Stein posted to her Jill2016 website that she had raised enough money to “file” for a recount in Pennsylvania. However, the Green Party candidate left out some key details about the filing of recounts in Pennsylvania that many of her supporters likely would have wanted to know before donating. For example, candidates cannot file a direct request for a recount in the state and instead must appeal the election in court.

She claimed “data” has suggested a need for recounting “machine-counted” votes in these particular states, which also happen to be states that Trump unexpectedly beat Clinton.

Should all three states be overturned in a recount, Clinton would have enough electorates to win the election. However, Stein did not make the recount process clear for her donors. Her outline makes it sound as though a candidate can simply file for a recount if they raise enough funds for the filing fee.

While the filing fee and request is all that is needed in Wisconsin, her second state “funded” is much more complicated. Pennsylvania does not allow candidates to file a direct request for a recount, according to the Pennsylvania Election Code. Instead, the filing fee is simply the amount needed to appeal the results.

During the appeal process, the court may determine that a recount is necessary.” Per Pennsylvania regulations, there is only one way remaining for Jill Stein to get a recount in Pennsylvania and it is a complicated process. BillyPenn reports that Stein would have to file for a court appeal and present a “prima facie case” showing that voter fraud took place. While prima facie has a lower burden of proof threshold than “beyond reasonable doubt,” it is still significant. Stein would have to prove in court that fraud was “probable.” This is going to be very difficult given that even the computer specialists recommending the recount say there is no proof of hacking or fraud.

However, since Stein has funded and initiated the effort, Elias says that Clinton will participate to ensure fairness.

Stein has maintained that the effort is not designed to overturn the election results, but rather to ensure transparency in the voting process. Stein has even criticized Clinton for joining her efforts so late in the game, calling her “on-again, off-again about democracy.”

It should happen then since the GOP controls both houses and the Governors mansion. Plus the WI State Supreme Court has a 5-2 conservative majority. The state supreme could also shut down the recount if it puts the states EV’s at risk, especially if ongoing recall totals show no significant change from election totals.

Wouldn’t also surprise me to see Walker introduce legislation to tighten up criteria for requesting recounts beyond just being on the ballot and being able to pay the recount fees. Maybe like only candidates on the ballot who got more than 20% of the vote can request one and that person must also present some proof of fraud or tabulation error caused them harm. Also establishing an automatic recount threshold level (most states its below 1/2 of 1%) and giving state election commission more latitude to reject recount requests.

Regarding cheery picking counties, this was tried in the Bush/Gore situation. Gore asked to recount counties that were strongly democrat and he lost by 500. If he had asked for the whole state, he would have won.

Jill Stein “wasn’t even on the ballot in MANY states.” How many states counts as many? She had no ballot status in 3 states, write-in status in 3 states, and ballot status in 44 states and DC. I think she had more states this time than in 2012. Here is a map on that status:

It is not that hard to own 3 homes if you live long enough and are frugal with your money. I think Sanders is that on both counts. Since 2006 his congressional salary has averaged $170,000. Recently, his family income has been $205,000 including his wife’s income. Do you even know if Bernie’s vacation home is owned free and clear or if he has a mortgage? Does he have any rental income on his properties? So many possibilities, not hard at all.

That thought crossed my mind. If PA stands, Trump already is over 270, making WI & MI result irrelevant. So yes, Trump needs to lock up PA.

You can’t be serious. Taxes on $200,000 are half. Property tax on 3 homes is staggering back east. It is not just owning homes. It is upkeep and maintenance. And then if there are mortgages he is so far underwater. If you have ever owned a lot of real estate something always goes wrong.

If you don’t learn to fix yourself the cost of plumbers, electricians, contractors buries you. I don’t think Bernie knows what a screw driver is.

Probably Soros not Hillary. While she and Bill will not be touched by a Trump administration, being a former president and first lady....The real people and groups behind many of the former presidents are fair game. The goal is disruption and possibly fighting to delegitimize Trump and keep him from investigating and taking those people and groups down by any means possible. If this administration does not prosecute the people and groups behind the globalist....they are just as powerful the moment they get back in power.

There is only one chance left for this country and it is a slim one.

The Dems may discover that if the “forensic” examination of the machine votes in Pa. goes forward, that they may come to regret it as the process will discover massive cheat fraud in Philadelphia for Hillary. The Dems won’t want the cheat mechanisms exposed!

There were some articles written where a liberal reporter investigated the votes of all counties in Florida and he had to ruefully admit that even if the whole state was recounted, Gore still would have lost by about 300 to 500 votes. So there were arguments(early 2000’s) countering your “whole state” view.

It all depends on where back east you are talking about. NJ property tax is terrible, DC is not so bad and senior citizens can pay 1/2 the regular price. Bernie’s property in DC is a condo bought in 2000. His home in Burlington, VT probably is not that heavily taxed. It is a part rental property valued at between $100,000 and $250,000 with income. His wife retired from a $160,000 a year job as president of Burlington College in 2011. The vacation home was bought with the proceeds of a family home of hers owned in Maine since the last century. As I said before, not hard at all, especially if your wife is also working or has income and property.

I am not sure what you mean by “Taxes on $200,000 are half.” I’m sure that the former Mayor of Burlington, VT has friends and reliable repair people or someone managing his rental property. Although taxes are high in VT, taxes are also a deductible business expense for rental property. Maintaining a condo in DC is a lot easier than maintaining a house.

That’s insane. She lost NC by 4% and around 150k votes. She going to challenge Florida next? He won FL by 1.2% - same margin as Pennsylvania! Hopefully the state judge Stein must go to WILL out a stop to this recount nonsense (if they go by the letter if PA Law, they must deny her petition)! If PA doesn’t get recounted that should end this crap as Hillary will not be able to steal enough EV’s to win EC vote!

This article indicates that according to which ballots were counted and judged by which method, Gore could have won, or Bush could have won. So, regarding the recounts undertaken this election those decisions could be very critical to the final results, which was basically my point.

I’ve owned real estate for decades and here in Arizona and Mexico. What I know for sure is that if you are not good at maintaining it yourself, you get eaten alive with costs. What I mean is that on $200,000 salary taxes federal, state and city take 50%.
