FBI Rewrites Federal Law to Let Hillary Off the Hook

There is no way of getting around this: According to Director James Comey (disclosure: a former colleague and longtime friend of mine), Hillary Clinton checked every box required for a felony violation of Section 793(f) of the federal penal code (Title 18): With lawful access to highly classified information she acted with gross negligence in removing and causing it to be removed it from its proper place of custody, and she transmitted it and caused it to be transmitted to others not authorized to have it, in patent violation of her trust. Director Comey even conceded that former Secretary Clinton was “extremely careless” and strongly suggested that her recklessness very likely led to communications (her own and those she corresponded with) being intercepted by foreign intelligence services.

Yet, Director Comey recommended against prosecution of the law violations he clearly found on the ground that there was no intent to harm the United States. In essence, in order to give Mrs. Clinton a pass, the FBI rewrote the statute, inserting an intent element that Congress did not require. The added intent element, moreover, makes no sense: The point of having a statute that criminalizes gross negligence is to underscore that government officials have a special obligation to safeguard national defense secrets; when they fail to carry out that obligation due to gross negligence, they are guilty of serious wrongdoing. The lack of intent to harm our country is irrelevant. People never intend the bad things that happen due to gross negligence.

18 U.S. Code § 793(f) - Gathering, transmitting or losing defense information

(f) Whoever, being entrusted with or having lawful possession or control of any document, writing, code book, signal book, sketch, photograph, photographic negative, blueprint, plan, map, model, instrument, appliance, note, or information, relating to the national defense, (1) through gross negligence permits the same to be removed from its proper place of custody or delivered to anyone in violation of his trust, or to be lost, stolen, abstracted, or destroyed, or (2) having knowledge that the same has been illegally removed from its proper place of custody or delivered to anyone in violation of its trust, or lost, or stolen, abstracted, or destroyed, and fails to make prompt report of such loss, theft, abstraction, or destruction to his superior officer—

Shall be fined under this title or imprisoned not more than ten years, or both.

What must be observed is that had “intent” been the standard ( it wasn’t) it was easy to prove her intent. Did she intend to jeopardize the national security? Probably not because she is to stupid to understand hacking but the issue was did she intend to put government documents on her off premises serverS?

One of the things I find stupefying, which I do not believe anyone has commented on is Comey’s unorthodox going out on a limb of to fall on his sword for Hillary and the Administration. First, I find it odd that the Bureau, via Comey has taken full blame for a nolle prosequi determination when it is not even his role to do so. In so doing, Comey has further corrupted the FBI and destroyed any credibility they may have enjoyed. The question is why? Most know that agents investigate, develop the facts and then they make their best pitch on the evidence in the case to an AUSA who decides whether to take the case to a Grand Jury. Comey should have done exactly that. He should have had his lead agents on the case truck over to the Public Integrity Section at DOJ, pitch the case the way Comey did at the beginning of his speech to the attorneys in their offices and leave the prosecution decision to Public Integrity lawyers. No, he volunteered to make a fool out of himself, shield Lynch and Public Integrity from doing her job and destroy the Bureau by representing he had the authority to control the case and make essentially a nolle pros determination in the case. How crazy and corrupt is that? What do you think the morale or lack thereof must be in the Bureau today among the rank and file agents? Bozo has done to law enforcement what he has done to the military. Wow! is all I can say to such a blatant act of in your face corruption. Yori Bezmenov warned us that a critical step toward totalitarianism is ‘demoralization’ and this whitewash of major national security criminal violations is just the latest appalling example. Do not succumb to the Communist playbook. Fight against totalitarianism to your last breath. It is obvious that once Obozo got away with flipping his finger at all of us regarding his usurpation of the office of POTUS, he knew he was home free to run roughshod over America and he is not through yet by a long shot, especially as it becomes clearer that Trump is going to win in November.
