The key statute is clearly written to require "gross negligence" and NOT intent. Comey is creating an artificially high barrier and then saying the hurdle has not been met. In fact, it is clear-cut that Hillary should be prosecuted.
In fact, it is Comey who is totally UN-reasonable to say that “no reasonable prosecutor” would indict based upon this fact pattern and statutes. That was a totally egregious, unnecessary assertion by Comey. If he did not have the judgment and guts to publicly recommend indictment, he could have kicked the political football to AG Lynch and required her to take the heat of deciding. Instead, he tries to make it easy for Lynch to let Hillary off the hook.

I have older family members (retired) who held top secret clearances in the US Navy and who are simply appalled at this case. They lived decades of their lives under a discipline in which one document left out or mislaid could end or derail a career, and in which doing anything remotely like what Hillary has done would result in certain jail time. Yet, if you are the right kind of “elite” in our political world you can just about get away with murder.
