Democratic Law Prof: ‘Difficult To Imagine’ Hillary Clinton Not Being Indicted

A Democrat law professor and former Department of Justice official with decades of experience in government secrecy says “it is difficult to imagine” . Dan Metcalfe dealt with information disclosure issues for more than 25 years as Director of the Justice Department’s Office of Information and Privacy, including during the Clinton administration. He now teaches secrecy law at American University’s Washington College of Law. He wrote in a Sunday column in LawNewz that “given that the facts and law are so clear in Ms. Clinton’s case, it is difficult to imagine her not being indicted” unless the White House or a top DOJ official intervenes.

For those of us who recognized from the outset that Ms. Clinton’s exclusive use of a personal email system for all her official business (not to mention her unprecedented use of a private server atop that) was a clear violation of the Federal Records Act (‘FRA’), the findings of the State Department’s Inspector General (‘IG’) to that effect in his May 25 report were no surprise. In fact, on the admitted facts of the case, no other conclusion was possible, and it was simply another ‘shoe waiting to be dropped.’

Metcalfe describes himself as a “registered Democrat who has long said that he will vote for Hillary Clinton in November” if she gets the nomination and does not get indicted. He goes on in the column to refute Hillary’s many arguments defending her email use.

No, her self-serving email set-up was not ‘allowed’ under the State Department’s rules. No, she was not ‘permitted’ to use a personal email system exclusively as she did. No, what she did was hardly just a matter of her ‘personal convenience.’ No, there is no evidence that any State Department attorney (other than perhaps Secretary Clinton herself) ever gave ‘legal approval’ to any part of her special email system. No, everything she did was not “fully above board” or in compliance with the ‘letter and spirit of the rules,’ far from it. Yes, she was indeed required by the FRA to maintain all official emails in an official system for proper review, delineation, and retention upon her departure. Yes, her private server equipment was in fact the subject of multiple attempted intrusion attempts (i.e., hacks), including by foreign nations. The list goes on and on. (Note that this does not even include Ms. Clinton’s many serious “misstatements” about her handling of classified or potentially classified information.)

The State Department Inspector General published a report in late May saying Clinton violated agency policy by using her personal email and server, the latest sign an indictment is a serious possibility. She has been under fire for months for sending classified information over her personal email using a private server she kept in her home instead of using secure government channels. The scandal has plagued Clinton as a potential indictment hangs over her head.

Please understand, from a legal and political point of view, this whole issue is a disaster for Hilary.

If she is indicted, we have a person facing 6-10 years in federal prison running as the Dem candidate for President.

If not indicted, every older FBI agent on the case (there are more than 150 SAs on the investigation) will retire in 72 hours and rush their book into print.

If pardoned by Obama, the public perception will be as bad, because "only big time criminals get pardoned."

Also, rumors tonight in DC, that Mrs. Web Hubble knows EVERYTHING and is still very pizzed that her husband Web was not pardoned with all the other pardons were purchased on Clinton's last day in office.

Actually the latest I heard today from the Clintoon flying monkey squadron was that Hillary had a privates server because the government email servers had been hacked by foreign sources in the past. She was doing this in order to keep the information more secure by hiring Brian Pagliano to set up her own personal (safer) server.

I kid you not.

Translation = The Clinton Foundation has stopped sending checks to Mrs. Hubbell.

Can you imagine the volume of payouts going out every month from that personal bank of hers? Blumenthal, Podesta, Mills, Abedeen, Anne Frank, media hacks, etc....I bet the payroll is in the millions per week.

The alligators are being fed by the Clinton Foundation Bank, but when the food stops, them gators are gonna start from her toes and work all the way up to her cackling pie hole.

It is a lay down felony to have simply moved the server. Then to put any government document on that server is 1 crime. Then to put 2000 classified documents is 2000 crimes. Then to 24 top security memos on that server is TREASON.
We have learned that she and Bill and chelsey and bloomenthal and mills and humma weiner and jake sullivan are all now under “rico” investigation for funneling money for favors to the family feeding trough- the “ foundation” which siphons 90% in their pockets .
But here is my point. Indict the bitch now on the SERVER/EMAILS!! It is over!! take your 150 FBI agents and do all you want on bribery. The FBI is losing its non political reputation. GET IT ON!!

I'm afraid of the following scenario:

Comey has so much data, so much evidence with multiple felonies that he recommends indictment to Loretta Lynch. She checks with Obama and Jarrett and they say, "Okay, go ahead with a Grand Jury."

The D.C. Grand Jury, all dems, all minorities, after 'exhaustive' review of Comey's overwhelming evidence with 100+ years of indictable offenses, find a "No Bill" on the case.

"A no-bill means that the Grand Jury decided that was not sufficient evidence to send your case to District Court for prosecution. While a Grand Jury can turn around and change its mind and issue an indictment, up until the time that the statute of limitations time period runs for that offense, that is extremely rare."

So, there you have it, they jump through the hoops, have plausible denial, and she walks.

But, can you go the Special Prosecutor route rather than a Grand Jury? When do they do Special Prosecutor vs. Grand Jury? Can Comey request a Special Prosecutor? . . recommend one with his announcement?

The email/server scandal, espionage case is one huge area. Her Blackmailability, etc. . lots of possibilities there.

The Clinton Foundation/Clinton Global Initiative international money laundering octopus is a whole other huge area.

It really is a joke and a travesty of our justice system that this person is actually running for President and just might really be the democratic nominee for President. She should be tried for espionage and treason at a bare minimum. Will we ever know the true extent of her voluminous crimes?

Dan Metcalfe is full of shite.

On one hand his statements appear to assume there is some sort of rule of law in this country. There isn’t, particularly where Democrats are involved, and more particularly where the Clintons are the perpetrators.

OTOH, while stating that she has committed serious crimes for which she *should* be charged, he follows with the statement that if she is not indicted (because of executive branch corruption which he is more or less acknowledging) he will vote for her. He is essentially saying that there is no rule of law and he is quite OK with it.

The crime is not in the doing, it is in the getting caught. And even that doesn’t count with Crooked Hillary.

Hillary may get jettisoned from the campaign before this is over (better than even odds she won’t) but she’s not going down via the corrupt legal system in this country.

No, the travesty is that so many millions of people in this country (like some of my in laws) openly admit they know she is a criminal and they want her to be President.

And that, my FRiends is why this country is in the crapper and circling the bowl. Not Hillary, but your next door neighbor who actually wants a traitor in the WH. Getting her out of the picture changes none of the underlying moral corruption which is endemic in this country.

So Doug Band and Teneo are boasting that Band handled ALL aspects of Hillary becoming Secretary of State. “All” means ALL, as in everything. Given that Teneo paid the IT dude, is Doug Band on the subpoena list for the FBI investigation??

Is Doug Band giving a deposition for the Judicial Watch lawsuit?? Anyone know?? This seems like a great point to press on......

So Doug Band and Teneo were involved in “ALL” aspects of Hillary becoming Secretary of State. Has this been noticed before?? Seems like both the FBI investigation and the Judicial Watch lawsuit need to focus some attention on Doug Band and Teneo. Does anyone know how to bring this point to the attention of relevant investigators before it is too late???
