Obama Decrees ALL Public Schools Must Allow Transgender Bathroom Use

The Obama administration will send a letter to every public school district in the country Friday warning them that they must allow students to use whatever bathroom and locker room corresponds to their stated gender identity, or face a federal lawsuit.

The decree, sent jointly by the Department of Justice and the Department of Education, comes just a few days after North Carolina and the federal government sued each other over the state’s recent law governing bathroom use in public buildings. It won’t be a new federal law, but will instead reflect the Obama administration’s interpretation of existing federal anti-discrimination law.

In particular, the decree is based on Title IX, the 1972 law prohibiting sex discrimination in schools that receive federal funding. While the drafters of the law may not have known it at the time, the Obama administration’s position is that the law covers discrimination based on gender identity as well as physical sex.

“A school may not require transgender students to use facilities inconsistent with their gender identity or to use individual-user facilities when other students are not required to do so,” the letter says, according to The New York Times, which obtained a copy.

Currently, federal courts have not conclusively settled whether, and to what degree, sex discrimination laws cover matters of gender identity as opposed to physical sex. But the Obama administration appears optimistic that an aggressive approach will succeed, especially after an April court ruling favored a transgender Virginia girls who sued for the right to use a boys’ bathroom.

The letter says that schools must immediately respect a student’s new gender identity as soon as it is declared by their parent or guardian. Schools are not allowed to require that a student provide a medical diagnosis to justify the change, and they also cannot require a student to legally change their gender.

To assist schools in implementing the new policy and help those made uncomfortable by it, the letter includes a 25-page document of “emerging practices,” with suggestions such as erecting privacy curtains in locker rooms for those who need extra privacy.

Obama’s new order will without a doubt enrage many Republicans who have argued that transgender bathroom policies will allow perverted men to prey upon women in bathrooms and locker rooms. A few such incidents have already occurred.

In February, for instance, a Seattle man used the city’s now transgender bathroom ordinance to enter a women’s locker room and begin stripping while young girls were using it. When confronted, he said the law gave him the right to be there, and he was never identified or arrested.

As you can see from the article itself and the link it contains, this has been confirmed by the NYT.

A couple of points.

If Republicans needed a wedge issue for the 2016 General, this is one. Under the law, any 9th Grade boy can walk into the girls locker room at school and using a hidden camera, begin to video my grandchildren.

We have to be very careful how we "rebel" under this. Our opposition cannot simply be labeled as "anti-gay." We must been seen as "anti-pervert" and a huge Washington overreach into our local classrooms.

We need to make our opposition easy to understand, such as:

"Certainly there are people with gender problems, but to me that seems like a disease invented by lawyers and Washington bureaucrats with way too much time on their hands... and too much power too, rather than a real diagnosis from a real doctor like my children's pediatrician who has cared for them since they were babies."

"The president's daughters, Sasha and Malia go to a high-priced private school, but I wonder if some perverted boy forged a note from his parents, would the Secret Service let him in the shower with the President's girls while they showered after Phys Ed?"

"You know, when people like Obama and Mrs Clinton become lawyers, all they care about is what is so called "legal", in other words, what they can get away with. They simply have no respect for what the rest of know is right or wring."

When a Republican is President, he can’t do ANYTHING without getting BOTH HOUSES of congress to agree with him to do it. Anything less than that, and it’s “oh, sorry everyone, we wanted to do X, but congress wouldn’t go along, so it’s just not going to get done.”

When a Democrat is President, he can do ANYTHING HE WANTS and it doesn’t matter if both houses of congress are controlled by the opposition. NOTHING STANDS IN HIS WAY.

Thank you for referencing that article Strac6. Please bear in mind that the following critique is directed at the article and not at you.

Lawless Obama isn’t the real problem concerning this issue.

The real problem is Congress. This is because corrupt, state sovereignty-ignoring Congress has the constitutional authority to stop from doing this unconstitutional action with public school restrooms but will probably refuse to do so, not that public schools will comply with Obama’s unlawful edict.

Remember in November !

When patriots elect Trump, they also need to elect a new, state sovereignty-respecting Congress that will work within its constitutional Article I, Section 8-limited powers to not only support Trump, but also put a stop to unconstitutional federal interference in state affairs, the Obama Administration promoting constitutionally unprotected LGBT agenda issues in this example.

Also consider that such a Congress would probably be willing to fire state sovereignty-ignoring activist justices.

Sometimes I think this isn’t about the sexually-confused or the restrooms they use. It is part of an effort by the government and other entities to destroy any vestige of traditional civilization. It is also an effort to extend federal control over anything it can control.

Years ago I had an acquaintence who joined a religious cult that incrementally took over every aspect of members’ lives. They even prescribed when, where, and how often married couples had sex. Faithful members evidently went along with it. I guess the cult leaders figured if they could control the most intimate aspects of members’ private lives, they had those people for good.

If the federal government can dictate restroom access policies in almost all the schools in the country, then what is next? Where does it stop?

It seems to me that if the congress wanted to include gender in title IX then they would have put it in the bill. Gender <> sex.
