You may be right on that, but it's hard for me to see how Baby Donald's public Tweets were not malicious.

In contrast to Mr. Trump, most politicians don’t engage in this type public bickering personally. They allow surrogates to speak for them and thus remain above the fray. The potential damage is not the loss of a lawsuit, but the discovery process where Mr. Trump can be questioned extensively under oath.
