Members of the Morning Joe panel tried their best to block and tackle for Hillary given the revelation that the person who set up her server has been granted immunity. Former Attorney General Michael Mukasey said the most troubling issue is the way things got from the SIPRnet--a Pentagon system used for exchanging Secret information--to Hillary's server.
Mukasey explained that someone must have taken something off SIPRnet and either transcribed it or summarized it and then put it on her server. Politico's Jim VandeHei suggested hopefully that if charges are brought it would be against the "staffers" who did that, rather than Hillary. Mukasey batted that away: "if she ordered that that be done . . . if she knew that that was the way it was being done, that it is being done on her order, that's a problem."

Think of it as at least a two-fer.
In order to peddle access (to the email, which begets access to her, which begets...) she had to skirt the classified data rules. The classified data lawbreaking is much easier to establish, and once established it actually serves as evidence in the more serious offenses.
JMO, and I am no lawyer - just an engineer with a concentration in psychology.

After the Congolese government attempted to regain control of its own mines, the State Department intervened on behalf of Lundin Mining and another mining company, Freeport Mines, also a Clinton foundation donor.
A round of talks in 2010, thought to be aided by the Clinton State Department, concluded with the pair of well-connected companies retaining their stakes in the mines and with the Congolese government being shut out of its own resources. (hat tip Schweizer book---Clinton Cash)

A key aide of Hillary Clinton emailed classified information about the government in Congo to a staffer at the Clinton Foundation in 2012, according to a copy of the correspondence obtained by the Washington Free Beacon.
Cheryl Mills, Clinton/s chief of staff at the State Department, sent the email to the Clinton Foundations foreign policy director, Amitabh Desai, on July 12, 2012.
The message, which was originally obtained by the group Citizens United through a public records request, is partially redacted because it includes foreign government information that has been classified Confidential by the State Department......but was not marked classified by the State Department until this past summer, intelligence sources tell the Free Beacon that it would have been classified at the time Mills sent it because foreign government information is considered classified from inception.
The message could add to concerns from congressional and FBI investigators about whether former Secretary Clinton and her aides mishandled classified information while at the State Department.
About half of the forwarded message was redacted due to its classified nature before the State Department released it to Citizens United last month. Although it is not clear what the redacted section includes, the State Department said in a court motion filed last week that it concerns both foreign government information and critical aspects of U.S. foreign relations, including U.S. foreign activities carried out by officials of the U.S. Government.
The State Department added that the disclosure of this information has the potential to damage and inject friction into our bilateral relationship with African countries whose cooperation is important to U.S. national security.
The Clinton Foundation and the State Department did not respond to request for comment about the email, or say whether Desai...a non-government employee who has worked at the foundation since 2007....would have been authorized to view Confidential information.

EXHIBIT FOUR--- The State Dept email, which discussed the relationship between the governments in Rwanda and the Democratic Republic of Congo, was originally drafted by Johnnie Carson, the State Department/s assistant secretary for African affairs, who sent it to Mills State Department email address.
Cheryl Mills later forwarded the full message to the foundation/s operative along with talking points for ex-President Clinton shortly before Bill Clinton was scheduled to visit the Congo region.
That line of thought dominates my alumni forum, and all the liberal Seattle lawyers are spinning numerous webs to obfuscate the issue of breaching national security.
no republican has the cojugles to prosecute her the press would flay them. they would cry that it a apolitically motivated, and claim UN protection for her as a political prisoner.
I believe part of what is taking so long is the FBI investigation has become so widespread. I think there are literally hundreds of people with their cajones hanging in the wind just waiting to be lopped off.
Part of having a security clearance is a legal responsibility not only to protect classified information, but to report any possible breaches of security. So every person who was on the receiving or BCC or CC lists for any of those emails containing classified information, and did not report it - is now under investigation.
Sure, some of them (many probably) will claim they had no way of knowing the information was classified. I might even believe some of them. But with 1200+ emails going to who knows how many hundreds of people, many of whom have clearances and should know better... There have got to be dozens of people with no reasonable excuse for not having reported the security breaches. Those people deserve a cell next to Hillary's, or a spot on the wall next to Hillary in front of the firing squad.
This is a massive case, and right now there are no-doubt hundreds of people answering some very uncomfortable questions and dozens looking at career-ending indictments and possibly jail time.
The security personnel I've worked with are extremely competent, serious, and apolitical when it comes to their jobs. Now, higher up things no-doubt get complicated. If/when the FBI turns over case files and recommends dozens of indictments here... If the DOJ does not indict virtually all of them, it is the end of the rule of law. They'll never be able to prosecute another national security case, ever.
