Wouldn’t that be arbitration, not court? Most contracts allow for binding arbitration over disputes in conditions of the contract.

Yes. Arbitration clauses between and/or among parties, which explicitly waive a jury trial, are fully enforceable so long as they comply with certain procedural and substantive safeguards.
