Automakers Say You Don’t Really Own Your Car

EFF is fighting for vehicle owners’ rights to inspect the code that runs their vehicles and to repair and modify their vehicles, or have a mechanic of their choice do the work. At the moment, the anti-circumvention prohibition in the Digital Millennium Copyright Act arguably restricts vehicle inspection, repair, and modification. If EFF is successful then vehicle owners will be free to inspect and tinker, as long as they don’t run afoul of other regulations, such as those governing vehicle emissions, safety, or copyright law.

Most of the automakers operating in the US filed opposition comments through trade associations, along with a couple of other vehicle manufacturers. They warn that owners with the freedom to inspect and modify code will be capable of violating a wide range of laws and harming themselves and others. They say you shouldn’t be allowed to repair your own car because you might not do it right. They say you shouldn’t be allowed to modify the code in your car because you might defraud a used car purchaser by changing the mileage. They say no one should be allowed to even look at the code without the manufacturer’s permission because letting the public learn how cars work could help malicious hackers, “third-party software developers” (the horror!), and competitors.

John Deere even argued that letting people modify car computer systems will result in them pirating music through the on-board entertainment system, which would be one of the more convoluted ways to copy media (and the exemption process doesn’t authorize copyright infringement, anyway).

Wow now through new trade agreements that are about to pass they are saying you cannot repair your own car that you own. Yes you read that correctly.

This is because say you might violate copyright laws.

Good grief I can't even believe this is even being considered?

If they allow this, every American should walk down to the nearest STEALERSHIP and protest.

Working on your own car is an American right and tradition. This is about ripping you off and making the right to work and repair your own property illegal.

In a kind of similar fashion, we don’t really own our homes, since, there are a ton of regulations that prevent us from modifying our homes without first checking in with local governments and with other regulatory bodies.

But, in reality, we don’t own our cars or our homes, until the respective ‘mortgages’ are paid off.

It seems like any right that the Supreme Court upholds, then the feds circumvent it through treaties that are not even properly ratified, through so called fast track, by the congress.

If only it was that innocent.

This is really about not allowing the citizen the ability to disconnect the coming cameras and tracking devices (black box) that the next iteration of the Patriot Act will encourage.

VW refused to turn off the service vehicle now warning because I had done the service, not them. They said it was a liability issue. I haven’t been back. They recently sent me a recall notice that I needed new software as my car might not be in compliance with environmental laws. It’s getting 44 mpg and a guy who got his software updated said acceleration, power and mileage dropped.

Many new cars, including mine, have no transmission dipstick. This forces you to take it to the dealer for them to change the fluid and filter. VW charges $800. I do it for $69, but it’s a pain in the bottom.

Ownership....is a fairly simple issue.

Just so everyone understands: 60% to as much as 80% of dealership revenues are generated from service and parts.

Most people assume they make their money on selling vehicles. Not so.

This is why they are pushing for ownership of property, which you purchased: To enhance revenue opportunities at the dealership level.

Which is fine, if they change the way vehicles are purchased.

For instance; in a lease, the manufacturer and its agents(dealerships) are responsible for maintenance of vehicles. You are responsible for gas and insurance.

In a purchase, cash or financed, you own the vehicle outright at the end but, ownership transfers from the vehicle manufacturer once it leaves the dealership and it co-owned by the finance company and the purchaser.

Doesn’t matter if you finance through “Ford Credit” either. They are a wholly separate company.

If auto manufacturers want to enhance revenue then they need to come up with unique leasing.

This would be the equivalent of saying you cannot alter your cell phone, even if you bought it outright.

Same with computers. You would not be allowed to modify them in anyway whatsoever...

All of which is fine, so long as the manufacturer sells the property as a service, maintains a service level and takes the POS back at the end of a contract.

Then again, expect lawyers to get involved, particularly tax lawyers because a capital purchase is treated several ways for the purpose of reducing obligations to various givernments, mostly the Fedzilla....
