So I guess according to the NY Times that Judge Moore from AL is on to something. So I guess in all cases like Brown and Loving, KS and VA only needed to comply with the plaintiff actually suing and keep segregation and bans on inter-racial marriages for everyone else. According to Mr. Baude, Obama should channel Andrew Jackson and revise his famous statement "John Roberts has made his decision; now let him enforce it!".

A corollary question would then become: could the states tell the feds to take a flying leap? The answer is “yes”, when the feds operate outside the law.

We know of no administrative actions that could, and therefore we have no plans that would, undo the massive damage to our health care system that would be caused by an adverse decision. We've heard that BS before. The president told us 40 times he couldn't take executive actions to "amnestisize" millions of illegals. Then he went and did it. In this scenario, I fully expect Obama to simply ignore the court ruling. Who is going to stop them?

If the administration loses in King, it can announce that it is complying with the Supreme Courts judgment but only with respect to the four plaintiffs who brought the suit. So this legal genius actually thinks that SCOTUS rulings work this way?

Just scare mongering from the Democrat house organ. It helps the Democrats raise money by scaring their far left wing base.
The Supreme Court will affirm Obamacare by either a 5/4 or 6/3 vote. The only question is whether Kennedy will join with Roberts.

Didn’t the SC say that it is not their job to rescue the people from their bad political decisions?
Well, this appears to be a similar situation. It was a political decision not to compensate states that do not set up an exchange. This was purposely and openly done for political reasons. Now the democrats are asking the SC to pull their chestnuts out of the fire because their political scheming blew ul in their face.
Hey Libs, you can’t have it both ways.

The government estimates that millions of Americans will be left without affordable health insurance if it loses. Millions were left out of health insurance when it was ripped from them when Obamacare began; which was just a year ago! Now most have more expensive health insurance with less health care availability!
You are an IDIOT William Baude.

Can we dispose once and for all of the crock that the insurance that some people have is affordable? A low-income friend of mine who is single was quoted an insurance that has a $15K deductible!!! So essentially, he has a catastrophic insurance only, you know, the one that was supposedly not good enough to remain legal under Obamacare!!!

I understand what he is saying. And it does make sense. Never really thought about it before. The Court judgement would only affect those suing, but could/would be used as precedent for any further cases.
Which, too me, should actually help the Court come to the correct decision. Which is to deny the subsidies. Heck, it only applies to these 4 people......

That’s a great discussion to throw out there right before a decision.
I’m sure the SCOTUS will be happy to read their role is simply that of an appendage much like a hangnail or appendix, easily done away with.
