Here’s what Article IV, Section 3 of the Constitution says:

New states may be admitted by the Congress into this union; but no new state shall be formed or erected within the jurisdiction of any other state, nor any state be formed by the junction of two or more states, without the consent of the legislatures of the states concerned, as well as of the Congress.

I don't see how that would apply. These counties/cities aren't trying to form a new state, they're simply trying to leave one and join another. The only possible argument is 'state formed by the junction of two or more states', but again, there's no new state being formed, the boundary lines are simply being redrawn. Either way, I think NYC would be happy to get rid of the slightly more conservative rest of NY, and the other states likely wouldn't mind getting them!
