Eric Garner case is a judicial disgrace as Officer Daniel Pantaleo walks away a free man...
NY Daily News ^ | 12/03/2014 | Denis Hamell

... Pantaleo who applied the lethal chokehold on Eric Garner was supervised by an African-American female NYPD sergeant.

Having that black sergeant in charge of that crime scene takes race out of the equation. As awful as Pantaleo’s actions appear on that video, at no time does that black sergeant order Pantaleo to stop choking Garner.

With a population that is 70% white and 10% African-American, when a Staten Island grand jury is presented with a white cop supervised by a black sergeant applying a lethal chokehold, it eliminates the racial component.

The grand jury was then left with the decision of whether Pantaleo had malicious intentions. It decided that he did not. Case closed. ...

I didn't know till today that the police officer was being supervised by a black woman police sergeant who never intervened. She is actually in the video. I saw it on Fox& Friends this morning.

Officer Wilson was innocent. Pantaleo should be fired.

Common sense is not in his police toolbox.

Something, very important, in the GJ testimony allowed the officer to not be charged. We’re not privy to it yet.

You know what; if I were a white cop, I’d refuse to go into any minority neighborhoods. It simply isn’t worth it. These guys are dammed if they do, and dammed if they don’t.

We all sit back and cast our judgments on these police when in reality we have NO clue what these folks face on a daily basis.

Good people (Whites) who may have considered this profession are learning that it simply isn’t worth it.

The real culprits responsible for this senseless death are the mayor and his police department for having a policy of arresting people for such a minor trangression.

Why isn’t anyone putting Mayor de Blasio. on the hot seat over his stupid policy of wasting valuable police time on arresting someone for selling a cigarette?

If his street police force wasn’t ordered to spend their time on such an insignificant misdemeanors Eric Garner would still be alive.

How many policemen were involved in taking down this one man for a crime less serious than Jay Walking?

Are all the other more serious crimes so well under control and the Mayor is having trouble keeping the street police busy?

Maybe, all the White Police Officers should be prohibited from working in Black communities. What happens then? What would Sharpton, Obama and Holder complain about if that happened?

Let’s say you owned the store that Eric stood in front of selling single cigarettes.

Let’s say your customers kept complaining to you that they wouldn’t come back because this guy kept harassing them about buying cigarette every time they went in or out.

Let’s say that you asked him to quit 30 TIMES over 30 days, and he kept coming back.

What would be your next step ?

Was it a head lock or choke hold? I can't tell. Evidently, one is allowed and is taught to police and one is not.

When I first saw the video, it wasn't the take-down that bothered me, but the fact that none of the police officers tried to help him when he was on the ground waiting for the emergency vehicle. I don't know how much of the video was cut out. Did the police sergeant try to assist? Did anyone try to assist? Was he breathing? If he was then the take-down itself may not have been what killed him.

If 15 minutes of video on this “arrest” and the subsequent actions of the authorities is not enough to bring about probable cause for trial then why is everyone crying for police to wear body cameras?

I guess your choices would be to tell him to move along, tazer him, beat the snot out of him or kill him.

“Don’t resist arrest. Period”

Exactly right. If you comply, you will not die.

Maybe I am just different, but people standing in front of a store asking for something does not bother me, and I would never complain nor refuse to shop there anymore. Just walk on by, not a hill to die on.

If my store was a smoke shop, perhaps I would be upset, yet come to regret calling the police knowing someone would die, albeit he committed suicide because he REFUSED to obey order and got the ultimate Aztec kicking.

As has been said by other Freepers, it is the City Officials who are ultimately to blame with that outrageous Cig Tax.

I will never understand the NOT obeying a Police Order, never.

What did Eric Garner’s autopsy show?

It takes several minutes to completely choke somebody to death. The policeman let the victim go in less than a minute in the video. What did he really die from? Nobody has yet said he was choked to death.

I think the problem with the Pantaleo case is the blurring of the line between incompetence and criminal behavior. Just because he was incompetent and deserving of firing does not mean he needs to go to jail.

The Arrest. It is vital to separate out the actions of the police from the rationale for their action. That’s because by virtually any logic, it is the height of irresponsibility and depravity for a man to end up dead for selling loose cigarettes.

The law that led to this confrontation was pressed forward by former New York Mayor Michael Bloomberg; Garner had been arrested some eight times for selling “loosies.”

As Lawrence McQuillan reported in The Washington Times:
In January 2014, tough new penalties for selling untaxed cigarettes took effect in New York City. In July, emboldened by the new law, the city’s highest-ranking uniformed cop, Philip Banks, issued an order to crack down on loosie sales days before Garner died.

So in terms of police cracking down on Garner, the real responsibility lies with Bloomberg and NYPD Chief Bill Bratton. Idiot laws lead to meaningless deaths.
