That's correct. Both memos are on the Whitehouse website now.
The scam works this way: the memos instruct the agency heads to come up with plans to various diffuse things. They mandate Committees to do this (Communists love committees).
Then they will publish Administrative Rules which, after a comment period, will be published in the Code of Federal Regulations, which makes them just about law.
So he doesn't have to take the hit. Behind closed doors, he tells his agency heads what he wants, and Voila!, that's what comes out.
Agencies have been doing this since 1946. They have it down to a science now: publish a Notice of Proposed Rulemaking (NPRM), make the comment period really short, stonewall any negative comments, and publish the rule.
Done. It has the force of law, and no Congressman was ever involved.
And the President doesn't have fingerprints on it.
Yet again why Delegation - the writing of administrative law by federal agencies - is un-Constitutional.
