Federal judge orders hearing in illegal immigration case

BROWNSVILLE, Texas – Last week, U.S. District Judge Andrew S. Hanen ordered a hearing at 1:30 p.m. on Aug. 27 to address all pending motions in a complaint brought by California Attorney Orly Taitz (r) against President Barack Obama, Secretary of the Department of Homeland Security (DHS) Jeh Johnson; Director of Health and Human Services Sylvia Burwell and the U.S. Border Patrol Rio Grande Valley Station.

In July, Taitz filed an emergency application for a stay of the transportation of illegal aliens from the Southern District of Texas to California and other areas throughout the country due to a serious threat to public health, spread of infectious diseases, national security threat, crime threat and economic damages.

Her action seeks either to immediately order the turnaround and deportation of all illegal aliens or require them to be placed in quarantine for two months in an enclosed temporary or permanent FEMA facility in order to contain the spread of infectious diseases.

She is also seeking an emergency stay of the release of illegal aliens into the general public that did not complete two months of quarantine, did not undergo proper medical screening, do not have a written medical release, do not have a clean criminal record from their country of origin and do not have a signed order from a federal judge stating such aliens are legally entitled to live in the United States.

Taitz states the nation is being flooded by hundreds of thousands of illegal aliens as a direct result of Obama and his codefendant’s unlawful and unconstitutional actions.

Noting this flood of illegal aliens have brought with them multiple infectious diseases, including tuberculosis, measles, scabies, pertussis (whooping cough), lice, swine flu, bacterial pneumonia and more, Taitz also states defendants are transporting these illegal aliens, which include gang members, drug cartel members and suspected members of terrorist organizations, all over the country allowing them, without any identification, to travel wherever they wish on commercial carriers.

Taitz, who is also a dentist, says, as a healthcare provider who comes in contact with individuals who are affected by multiple infectious diseases and, absent quarantine and proper treatment, she is in imminent danger of contracting such diseases.

While defendants are transferring thousands of illegal aliens from the Southern District of Texas to California and elsewhere across the country and dumping them on unsuspecting communities, legal immigrants, particularly those from countries known for outbreaks of infectious diseases, must undergo health checks, chest X-rays for tuberculosis and obtain a medical release.

She stated legal immigrants must also provide a criminal record from their country of origin.

Taitz calls the current practice of dumping of illegal aliens into communities a sham process, with health screenings performed by border patrol agents, who do not have medical training, while carrying out only cursory criminal background checks to determine if they previously committed crimes in the United States.

Border patrol agents have admitted they are releasing illegal aliens who were self-professed murderers in their home countries. However, since they had no criminal record in this country, they were ordered to let them go.

The illegal aliens are then released and allowed to travel to wherever they want to go with just a letter advising them to appear in court before an immigration judge.

According to Taitz, over 90 percent never show up for their deportation hearings. She said the defendants are acting as de facto human traffickers, with the federal government actually completing the smuggling cycle.

On Aug. 1, Hanen ordered the defendants to show cause why the emergency relief requested by Taitz should not be granted and ordered the government to comply by Aug. 11.

Last year, Hanen issued a scathing order chastising DHS following a child smuggling case, in which the human trafficker who brought the 10-year-old illegal alien child from El Salvador to Texas was apprehended. The smuggler was paid $6,000 by the child’s illegal alien mother to bring the child into the country and deliver her to Virginia, where the mother resides illegally.

However, after the smuggler was apprehended by the border patrol, the U.S. government took over and delivered the child to her mother in Virginia.

The mother was turned down for a tourist visa in 2000 so she decided to enter the United States illegally and has lived here ever since.

In that case, Hanan stated even if the mother’s decision to smuggle her child across the border was motivated by the best of interests, it was not an excuse for the U.S. government to further the criminal conspiracy, and by doing so, encourage others to break the law and endanger additional children.

He wrote, “To put this in another context, the DHS policy is as logical as taking illegal drugs or weapons that it has seized from smugglers and delivering them to the criminals who initially solicited their illegal importation/exportation. Legally, this situation is no different. This court is not blind to the needs of a minor child, nor is it suggesting that a child should be punished for the crimes of her parent. Nevertheless, neither the Flores settlement nor a concern for common decency compels the government to not only aid, but also reward an individual for initiating a scheme to break the laws governing the border security of this country. Further, neither compels the government to aid the drug cartels who control this human trafficking.”

Hanan stated his court is aware prosecutors and law enforcement officers frequently exercise discretion to defer prosecution or arrest of individuals and it is not opposed to the concept of prosecutorial discretion, if exercised with a sense of justice and common sense.

He concluded by stating, “Nevertheless, it is not aware of any accepted legal principle, including prosecutorial discretion that not only allows the government to decline prosecution, but further allows it to actually complete the intended criminal mission. The DHS should enforce the laws of the United States – not break them.”

In ordering the Aug. 27 hearing, Hanan stated the topics that will be discussed include: 1) the standing of the plaintiff (either individually or as a class representative); 2) the ability of an individual citizen, even with standing, to question executive authority over immigration matters; 3) the defendants’ past and current efforts to secure the southern border of the United States (including the efforts to stop the influx of illegal aliens, minors and adults in 2014); 4) all aspects of the apprehension, processing and subsequent placement of the illegal minors in 2014 including specifically the recent influx from Mexico and Central America; 5) the defendants’ efforts to comply with the Flores settlement in conjunction with the recent influx of minors; 6) the application, if any, of the Deferred Action for Childhood Arrivals to this case; 7) the examination, diagnosis and treatment of any illegal alien minors with any medical conditions in 2014; and 8) the detention and/or all other means to house illegal alien minors who have entered the country in 2014.

Hanan stated, “The court will rule as quickly as it can after the hearing given the emergency nature of the motion.”

The Obama Admin has solicited ´a list of asks for the tech sector´ and ´provisions for low-skilled workers for industries, like construction´-including green cards and work authorizations-in order to ´get them on board´....

Chamber of Commerce members--including publicly-traded companies---should take heed.

There have been thousands of accusations of human rights abuse, extortion, and even reports of murder on the freight trains transporting undocumented migrants to the US border....many coming to work in their companies.

The trains involved in these are publicly-traded companies, traded on NASDAQ, with "very influential stockholders", such as the Clintons and billionaire Mexico resident, Carlos Slim. Other stockholders include,T Rowe Price, Bank of America, and General Electric.

The real eye-opener is that these freight train companies are involved in the Narco trade, and one report makes it clear that the companies are aware of the abusive practices their train operators are engaging in. The border swarm is all about human trafficking, narco trafficking, and government and corporate collusion.

Instead of waiting for Congress to do something, she is taking it to the Courts.
The Republicans and Democrats are ignoring what the people want and are planning to give amnesty to everyone that comes across the border. Maybe the judge is tired of this lawlessness and will rule in the American people’s favor.

No one else is trying. She at least is making an attempt.

Everyone knows his birth certificate is illegal, no one else will touch it when the MSM labels everyone as crazy who dares question it. We would all like to see a prestigious law firm take up all the illegalities of this admin (including having to prove he is actually a citizen), but they won't. So I don't know why jabbing at Orly makes people feel better.

I think she just may win her new case on trafficking of illegal aliens. This judge sounds like he is going to give it a fair hearing.

I called his San Antonio office.

A guy took down the info about the hearing.

After I finished describing the location and to send Senator Cruz your note about the hearing, the guy told me they know about the hearing and somebody from Ted Cruz associates will be at the hearing.

Press release: Judge Hanen schedules injunction hearing for Oct 27, right before the election, tells Enforcement and Removal INS agent: you don’t do either enforcement or removal .

Today was a grueling four and a half hour hearing . Now there are 3 attorneys representing the government and they brought to the hearing representatives of border patrol, DHS and HHS. Associated press sent their representative and AP report and interview should come out shortly. The transcript will be provided to the public when it is available. At the hearing the border patrol agent testifies that they do not have doctors checking the illegal aliens. The border patrol agents check them. The border patrol agent in charge did not even know what is an incubation period, he was clueless about the fact that it might take 3 weeks for Ebola to show or 2 months for Scabies to show.

A representative from HHS knew very little about what is happening in the camps which are run by the Baptist charities. She stated that there is a doctor in DC who oversees these facilities. She was asked by Taitz, don’t you think that it is insufficient for one doctor to oversee hundreds of children with TB, H1N1, scabies and other diseases. She said it is not hundreds. She was asked by Taitz, how many illegal alien children camps/ facilities are under her supervision, she said that there are 90. When asked how many children are there in every facility, she said: between 35 and 200, average being about 50. So, Taitz told her that by simple math, 90 camps with 50 children each, it would be some 5,000 or so children who are being seen by one doctor in DC, that is a ration of 5,000 to one doctor. She said: we have 2 doctors.

Further, she was asked about the transportation of illegals. Both HHS and INS officials are admitted that they are spending taxpayer funds to pay for airplane tickets for both illegal alien children and HHS/ INS employees supervising them.

The judge was really unhappy about what he was hearing. He said that what is going on is not the law, it is a policy by the government and it is not right. He said that instead of deporting illegal aliens, the government is spending tax payer money to transport these illegal alien children to their illegal alien parents.

The judge said: how can you even imagine that these people will ever show up for deportation hearings: illegal aliens are signing forms saying that they will make sure that their illegal alien children or other relatives will show at the hearings. The judge said that it is a common sense matter, it is clear that they will not show up. Further, the judge got extremely upset when he heard that HHS allows these illegal alien children to be released into custody of people who are not only illegal aliens themselves, but also people with a criminal record.

The judge also said that they should not be called children, these are mostly teenagers 14-17, who are being labeled as children, but these are not little children.

The judge also, asked the US attorney: do you want to tell me that the government might release from custody a person with Ebola or some other disease, this person will infect people around him, they will infect doctors, who come into contact with this person, doctors like doctor Taitz, and you tell me that people, who are affected, do not have any standing to sue the government?

INS rep admitted that he knew of people from Muslim countries, known for supporting terrorism, are crossing the border. Border patrol agent and INS agent admitted that TSA does not call them to verify whether the people, who board the planes without IDs, are indeed, who they say they are. INS agent admitted that when they don’t have enough beds, they just release illegal aliens on their own recognizance, they just let them go. In other instances they send them to Catholic charities, who buy buss ticket for them and drop them at the bus station. The audience at the hearing was gasping, it was crystal clear to everyone that the whole system is a complete sham. We do not have a National security and pretty soon we will not have a nation, this regime is simply destroying the national security, building the North American union and the New World order.

The judge asked HHS and DHS representatives: so, let’s say you fly these people to Idaho and they are supposed to appear for a deportation hearing there and they move to Montana, what happens then? The HHS rep said: then, I guess, they are in Montana. She was just shrugging her shoulders as the judge was shaking his head. She looked very uncomfortable. All he people, who were testifying, knew that what they are doing is very wrong, they knew that Obama administration opened the borders widely and there is zero border protection. At some point the judge told the INS enforcement and removal agent: you are not doing either enforcement or removal. All the witnesses were pretty much saying: don’t blame us, we are just following the orders.

Thanks for the update. Sounds like Orly has more work to do, the judge needs her to tailor the complaint to “your own damage and to your own claims.”

“BROWNSVILLE —A federal judge Wednesday denied California attorney Orly Taitz’s request for a temporary restraining order against President Barack Obama and others regarding immigration policies and practices, but did not dismiss her lawsuit.

Instead, U.S. District Judge Andrew S. Hanen advised Taitz that she might have standing for the lawsuit, "if you tailor the complaint to your own damages and to your own claims."

At the end of a near four-hour hearing in federal court in Brownsville, and in addressing her complaint and other issues regarding testimony that she seeks from several U.S. Border Patrol agents, Hanen also told Taitz, “I’m telling you no right now. I’m not telling you no forever.”

Hanen gave Taitz until Oct. 3 to amend her complaint, or petition, and gave the government’s attorneys Colin A. Kisor and Daniel D. Hu until Oct. 17 to then respond. Hanen set an injunction hearing for Oct. 29.

“It’s hard to determine what your causes of action are,” Hanen told Taitz at the onset of the hearing. He later advised that her complaint should be more concise.

This stems from the lawsuit that Taitz filed on July 14 in federal court against Obama, Department of Homeland Security Secretary Jeh Johnson, Health and Human Services Secretary Sylvia Burwell and the U.S. Border Patrol’s Rio Grande Valley Sector.

The lawsuit seeks an order to temporarily restrain authorities from transporting undocumented immigrants to other states, and that the immigrants be either immediately deported or held in quarantine for two months because, she says, they spread epidemics of scabies, tuberculosis, measles, whooping cough, swine flu, dengue fever, Ebola virus, and lice.”
