When I was a young investigator, I accompanied a senior investigator on his quest to see a defense attorney to seek the cooperation of the defendant. The smug attorney sat behind his desk and after intros pointed to a huge fish mounted on the wall with a short inscription under it. He said go read it. We did, this is what it said: I would not be here had I not opened my mouth. He then went on to say this is what my clients pay me a retainer for. My client is not going to say a word, he is not cooperating, and he is not going to plead guilty. He will not serve a day.
He was right.
Doesn’t lend a lot of confidence in your investigative skills if you needed the perps voluntary statement in order to convict him.
Have him take the 5th a bunch of times in front of a jury...then present your evidence....
