All good technical points, but that overlooks the political strategy. The statement is the beginning of a bogus executive privilege argument which will turn into a lawsuit which won’t be resolved until after the 2016 election.

Dems figure if they win in 2016, it won’t matter as ‘fundamental change’ will be complete. If they lose, they will be able to rely on the MSM to parrot a ‘let’s move on’ strategy. No question the ‘turn the other cheek’ Pubbies would fold in the latter case.

The "technical points" will destroy any political strategy. Issa and Camp should engage the most knowledgeable IT people in the country, outside and inside the government, to destroy this notion that the emails have been lost due to a computer crash. Emails are backed up every day, archived, and sent offsite. I worked for the federal government for 36 years. This claim of lost emails is preposterous and can be destroyed by the "technical points." No executive privilege or lawsuit can trump the "technical points" that the IRS explanation is a fabrication.

It is time to appoint another select committee on the IRS scandal, which is far more dangerous to our individual liberties than anything else save the NSA revelations.
