Unpublished research by university scientists is exempt from the Virginia Freedom of Information Act, the Virginia Supreme Court ruled Thursday, rejecting an attempt by skeptics of global warming to view the work of a prominent climate researcher during his years at the University of Virginia.

The ruling is the latest turn in the FOIA request filed in 2011 by Del. Robert Marshall (R-Prince William) and the American Tradition Institute to obtain research and e-mails of former U-Va. professor Michael Mann.

Also remember this when the pro-vaccine people demand only published peer-reviewed work.

Judges, copying SCOTUS Justices, who think they’re scientists.

Based on what I know about this issue, Virginia can throw as much state revenue as it wants to at global warming research (aka down the toilet) because such research is protected by the 10th Amendment.

On the other hand, if Viriginia is receiving federal funding for global warming research then that is a problem imo. It is a problem because the states have never delegated to Congress, via the Constitution, the specific power to address climate issues.

“Congress is not empowered to tax for those purposes which are within the exclusive province of the States.” —Justice John Marshall, Gibbons v. Ogden, 1824.

(How would crooks survive without the federal government?)

Good decision, lousy subject.

agree with you there. But it is telling the man-made global warming crowd is unwilling to be open about their "research."

Think about it. Replace ‘Climate research’ with ‘Nuclear Research’, or perhaps the next wave of technology that becomes the Economic cash cow for the U.S.

You still want working notes of Research Professors publicly available? Even to Foreign countries? Like providing free technology to China?

Because that’s the end result.

If my tax dollars pay for it, then yes. If it's nuclear or defense-related, then classify it. But for global warming, expose it all.

Unfortunate, but not unexpected. It means Michael Mann will get to hide any number of smoking guns which would destroy his credibility and dry up untold wealth gleaned from the corrupt and unethical warming alarmist enterprise.

It is amazing to me that his research is accepted without the raw data being available for scrutiny. If this were normal science that would be a major indication of fraud but this is not normal science. This science is being used to control economies both in the US and worldwide. The accountability should be higher, much higher.

oh, so our non-scientist judges get to pick and choose who’s raw research material gets to be released and who’s agenda they’re going to make judgement on? It doesn’t have to be nuclear. It can be something of tremendous value to the U.S.

The courts not supposed to have an agenda. And that’s exactly what you’re proposing.

Scientific findings without conclusive data to back it up is worth about as much as a scrap of paper.

A couple years ago, reading the tea leaves of approaching accountability, the East Anglia University climate lab of Phil Jones, which has been the hub of the IPCC activities and in collusion with Michael Mann and others, destroyed all the original data on which much of the IPCC's earlier reports were based. Their claim was that they didn't have enough storage space.

This alarmist scam is a multibillion dollar cash cow and the perps have no intention of backing away from the milking machine.

Hopefully discovery in Mann’s suit against Mark Steyn will bring this out anyway.

Although I've only been *directly* involved in medical research once (I was assigned to hold a chimp's mouth closed...yes,it's a long story) I've spoken to many physicians, most of them young, who've been deeply involved in research at Harvard Medical School. The stories they told about the research itself, and the data and documents they had to submit to professional journals (New England Journal of Medicine,Journal of the American Medical Association,The Lancet, numerous sub specialty journals)in order to get their papers published was beyond astounding. But these pigs, without a shred of credible evidence, want to bring the world back to the stone age, technologically,so that there's never again a foggy day in London and never again a heat wave on the Arabian peninsula or in the Australian Outback.Anyone who's ever traveled, recently,in China (as I have) knows that when it comes to air pollution China is Problem #1....#2....#3.....#4....

So the “Global Warming” cover-up continues, thanks to a corrupt judiciary!

“If this were normal science that would be a major indication of fraud but this is not normal science.”

It’s the same science that says homosexuality is normal
sexual behavior and not a mental disorder. It’s retarded,
it’s liberal and it’s a lie.

“China is Problem #1....#2....#3.....#4....”

There is really no proof that Chine is causing any change
either. They may pollute more but there isn’t any proof that
they are causing the earth to get warmer especially when
it’s neither warming or cooling.
