Editorial: Ted Cruz and the ‘birther’ issue

Is he a natural-born citizen or isn’t he? The question has been a nagging part of Barack Obama’s life ever since his first presidential campaign. No amount of birth certificates and sworn statements from state officials in Hawaii, his birthplace, seemed capable of putting the issue to rest. The “birther” movement continues pressing the question even today, five years after Obama’s election to the presidency.

The question nags anew, but this time Texas Republican Sen. Ted Cruz is the focus because he was born in Canada to an American mother and Cuban father. By law, his mother’s U.S. citizenship automatically confers natural citizenship to Cruz, just as — for those who continue to doubt the location of Obama’s birth — the citizenship of Obama’s American mother conferred it to him.

When it became a hot-button issue in 2008, Democrats countered that Obama’s GOP opponent, Sen. John McCain of Arizona, was born to American parents at a U.S. military installation in the Panama Canal Zone. The implication being that if Republicans wanted to play the birther game, Democrats could, too.

This is such a nonissue, regardless of whether the candidate is Republican or Democrat. Nevertheless, narrow-minded individuals, including some prominent personalities such as billionaire former presidential contender Donald Trump, are doggedly trying to concoct controversy and introduce doubt where there should be none.

These men have been natural U.S. citizens from birth and have every right to seek the nation’s highest office. Article II of the Constitution sets out three eligibility requirements to be president: that the person be at least 35 years old, a resident within the United States for 14 years and a “natural-born citizen.”

at this point in the controversy the issue raised should not be over eligibility but over the impeachable offense of forging the documents as provem beyond doubt by the Maricopa County sherrifs office forensic investigators

How this ever slipped through the cracks is beyond belief

Cruz has authored more than 80 United States Supreme Court briefs and presented 43 oral arguments, including nine before the United States Supreme Court.[3][21][19] Cruz's record of having argued before the Supreme Court nine times is more than any practicing lawyer in Texas or any current member of Congress.[43] Cruz has commented on his nine cases in front of the U.S. Supreme Court: "We ended up year after year arguing some of the biggest cases in the country. There was a degree of serendipity in that, but there was also a concerted effort to seek out and lead conservative fights." In the

landmark case of District of Columbia v. Heller, Cruz drafted the amicus brief signed by attorneys general of 31 states, which said that the D.C. handgun ban should be struck down as infringing upon the Second Amendment right to keep and bear arms.Cruz also presented oral argument for the amici states in the companion case to Heller before the United States Court of Appeals for the District of Columbia Circuit.

In addition to his victory in Heller, Cruz has successfully defended the constitutionality of Ten Commandments monument on the Texas State Capitol grounds before the Fifth Circuit and the U.S. Supreme Court, winning 5-4 in Van Orden v. Perry.

Cruz authored a U.S. Supreme Court brief for all 50 states successfully defending the recitation of the Pledge of Allegiance in public schools, winning 9-0 in Elk Grove Unified School District v. Newdow. Cruz served as lead counsel for the state and successfully defended the multiple litigation challenges to the 2003 Texas congressional redistricting plan in state and federal district courts and before the U.S. Supreme Court, winning 5-4 in League of United Latin American Citizens v. Perry. Cruz also successfully defended, in Medellin v. Texas, the State of Texas against an attempt by the International Court of Justice to re-open the criminal convictions of 51 murderers on death row throughout the United States.

Cruz has been named by American Lawyer magazine as one of the 50 Best Litigators under 45 in America, by The National Law Journal as one of the 50 Most Influential Minority Lawyers in America, and by Texas Lawyer as one of the 25 Greatest Texas Lawyers of the Past Quarter Century.

It takes a two-thirds vote in the Senate to find a president guilty of high crimes and misdemeanors and thus remove him from office. Which 22 Democrat Senators do you see voting Obama guilty? And that’s not even counting the RINOs.
Ten Republicans voted Bubba Clinton not guilty of perjury and five voted him not guilty of Obstruction of Justice.

Wrong! Obama's mother was too young and hadn't lived in Hawaii the required number of years past the age of 14.

He is a natural born citizen. I can’t think of any reason for him not to run. He has an extremely accomplished background, and the only reason I could see for him not running is his own personal decision.

A non-issue? Not to those of us who who regard the Constitution as the Supreme Law of the Land!

As with other issues, like service in the Vietnam War, the Left pushes the bar sky-high for Republican candidates and ignores it when it comes to traitors like Kerry.

Jim it’s a shame we’ll have to fight this battle here on FR. Cruz is eligible to be pres. End of story.

But there are lots of FReepers who don’t feel that way. The NBC wars will rage. A shame.

I intend to stay away. And I hope you and yours will police the Cruz threads and be on the lookout for FReepers trying to turn these threads into a NBC fight. Hijacked threads really do FR a disservice.

Actually there’s one other snag too. When officially requested to verify that Stanley Ann Dunham was Obama’s mother, the HI state registrar refused to verify that. But then, he also refused to verify that Obama was born male, that his birthdate was Aug 4, 1961, that he was born on the island of Oahu, or that Barack Hussein Obama was his father - all of which he was required to verify if those claims were made on a legally-valid BC...

We literally have NO IDEA who this guy is or where he came from. As effectively confirmed by the HI state registrar in the “certified statements” that this idiot author referred to in this article.

It’s a non-issue if he truly is a natural born citizen per law and the constitution. These folks and many others, like CATO for example, think he is.
