Physicians have no business interrogating patients about their guns

In the wake of the George Zimmerman verdict, President Obama and other anti-gun advocates have called for changing Florida’s pro-Second Amendment laws. Their chances of getting the “stand your ground” statute overturned are slim, but the anti-gun groups are making significant progress in the Sunshine State in allowing activist doctors to push their agenda to disarm families.

A federal appeals court heard oral arguments on July 18 in the case that has become known as “Docs vs. Glocks.” The issue before the court is whether a patient’s right to privacy and protection from doctors who ask inappropriate political questions about what firearms are in the family home trumps the health care providers’ rights to ask and to keep records of whatever they want.

The Firearm Owners Privacy Act, which Gov. Rick Scott signed into law in June 2011, says that doctors should not ask families about whether they own guns. But if they choose to do so, and a patient feels the doctor has harassed or discriminated against them, he can file a complaint with the medical board so that the doctor’s peers can decide if the accusation is legitimate.

“The wording in the law is ‘should refrain,’” Florida Solicitor General Allen Winsor told the justices of the 11th U.S. Circuit Court of Appeals, according to The Associated Press.”It’s not mandating anything. It’s recommending. The use of the term is critical in this case.”

The issue came about after repeated cases surfaced of children being asked by doctors if there was a gun in the home. During the legislative process, one mother said her pediatrician refused to continue treating her child if she did not respond to questions about firearms at home.

Well.....at least I don’t smoke.

But tomorrow is here. Whenever I have a doctor’s appt, the very first thing they do is weigh me, followed by BP, then bloodwork to reveal my cholesterol, blood sugar & all the other suspicious indicators of my unhealthy life style. That all goes into the database as a permament record.

Will I soon be receiving “Lifestyle Alert Notices” from the government? “Here are your vital stats for the past two years, indicating significant health issues regarding your weight, blood pressure, blood sugar, and BMI. These if not dealt with could affect your ability to obtain health insurance & other government benefits.”

“Do you own guns? Don’t lie to us, we have every Form 4473 that you have ever signed.”

“Stay safe, citizen.”

Do you know of some effort to type all that material in?”

The scanners that are available now are very capable.

Our FP who recently retired do to a lot of this stuff had joined a group a few years ago, and he was forced by the group to have his records scanned.

He basically limited it to about 3500 records of active duty patients and stored years of other old records off site.

He and his office staff were stunned at what was able to be scanned. If possible with inactive patients, he somehow got their records to them or their survivors over the decades so they weren’t scanned.

He and his final office sharing md had thousands of records shredded at their cost to prevent what was in those records getting out.

No such luck with the previously scanned medical records as they are/were part of the groups records.

I saw your follow on post. I know about the Revolutionary War, and am in agreement with how to deal with those on the other side - in the event of that scenario.

Your initial post did not clarify; you just made a statement about people starting shooting doctors.

That’s what I responded to.

That’s true, but since I’m a gunsmith, it’s a pretty safe bet that I’m around guns.

Lawyers, however, make doctors wish they hadn’t done something.

Many people due to high yearly deductibles and other bs are going to cash and carry mds for their health care.

Offer the doc $100 - $150 for each visit with no record keeping on his/her part. Then, you are not lying nor answering gun questions, that you don't want to answer.

I will be looking into this and will be letting our younger relatives know this. They need a trust anyway.

You will need SEPARATE TRUST for the firearms. My family has a revocable trusts, an estate trust, and a gun trust. Best $3000.00 I ever spent. All I have left to do is write my own obituary and plan my funeral.....and hope I keep the Mrs DCBryan1 happy ;)

So "should refrain" is not an order, but "we don't need you to do that" is?
"we don't need you to do that” is not only an order, it’s a retroactive order - it not only countermands the suggestion implied in “let us know if you find out which way he went,” and places you in the wrong for having started “to do that.”
So the solution is simple - pass a “we don’t need you to do that” amendment to the law, and whatever was suggested as being wrong will be illegal - probably even unconstitutional, for all you and I know. And effective ex post facto.

I didn’t say anything about being rude to your doc, If they ask, politely say no. After that visit, find another doc. Fortunately, here in Texas most of our docs are hunters and/or gun enthusiasts.

Lie to the doctor, then stop using him. Pretty simple to me.Lots, if not most doctors are firearms owners/sportsmen who won’t ask.

Obama is doing everything he can to turn doctors against him. Unfortunately for him, medical schools will not be able to produce enough Mengeles to satisfy Obamacare. Leftists tend to go to law school instead.
