SCOTUSblog publisher predicts: The Court will uphold the mandate

Let's hope the SCOTUSblog publisher is wrong. Given the ruling on AZ, we all have reason to be concerned by today's ruling. I am afraid that whatever decision is made will try to cut the baby in half rather than being definitive. If the mandate is upheld no matter how much the Court tries to limit its application, i.e., this would only apply to the unique circumstances of health care, our Constitution will be rendered meaningless.

So much is at stake today. Will the system rise to the challenge?

I dreamed a couple of days ago...that they DID uphold the WHOLE thing...Pray that dream does NOT come true!!

I agree with that, particularly with regard to the ruling on the separability clause. I'm betting the Court will rule that there is an implied separability clause in the law. This despite the obvious will of Congress to strike the clause from earlier draft versions of Obamacare.

The separability clause ruling should be a slam dunk. I'm betting it won't be and we won't be happy about the decision.

Most people seem to think the mandate will be struck down but I hope it’s the whole bill.

If they strike down the mandate and Obama remains in office (God forbid) he will just make it a tax.
