Police: Santa Barbara homeowner shoots intruder, suspect in custody(CA)

A Santa Barbara homeowner shot an intruder Wednesday morning, according to police.

Police said a 33-year-old man began knocking on the front door of a home in the 900 block of West Pedregosa Street. Police said the man inside the home woke up, and told the suspect to take off. Instead, police said the suspect uttered something about money, before walking around to the back of the home.

Police said the man's family called 911, as he armed himself with an M-1 carbine rifle. When the suspect showed up on the back patio, police said he yelled out something indicating he was suicidal, before picking up a lantern and breaking the glass doors with it.

Police said the victim inside shot a warning bullet through the door near the suspect, but the suspect continued to force his way into the home. Ten seconds later, police said the victim shot the man. The suspect was arrested after he was treated for the gunshot wound.

Because of the ongoing investigation, police are not releasing the suspect's identity.

I forget if the M1 carbine is considered an "assault weapon" under the arcane California gun laws. It is really hard to be sure what is prohibited and what is not.

ANYTHING that fires a bullet at a black perp is now considered an “assault weapon”. It’s not just in Kalifornia; it’s true in Florida, for sure, and most of the Nation now, too.

It doesn’t really matter, in California you have a duty to RETREAT, this poor homeowner WILL face charges, only the POLICE are Allowed to KILL unarmed individuals in CA with impunity, the Story only mentions a “Lantern” hardly justifiable to claim “I was in fear for my life” which is what is required. Note to Homeowner, next Time KILL THE THUG and have a disposable unregistered gun to put in his hand, if you don’t have an unregistered gun, Ask Any COP for one of his extra drop guns.

Did they take and keep the homeowners weapon. Did they take his clothes?

Did they arrest him for attempted murder?

When do we get to hear the 911 calls? Were there any muttered or un-intelligable comments that can be called racial slurs?

If the intruder was black, we can expect Jesse and Al...and the New Black Panthers on the scene soon and they have a workable SOP to go through to get this home owner arrested on at lease attempted murder charges.

Sad that such sarcasm could be so close to the mark depending on the race of the people involved.

They jumped on the Trayvon incident because there’s only one person who “says” Trayvon was committing a crime, that is, attacking Zimmerman. With all the other cases the crime is obvious.

The sad thing is it’s bringing back racist feelings even though everyone KNOWS not ALL blacks are thugs. But, like the muslims, good and decent blacks are not condemning the criminals.

With respect, California does not require one to “retreat”. In fact, California has a Castle Doctrine. If one illegally enters a home, a resident can use any means necessary to defend themselves, including the use of a “War Baby”, aka a M1 Carbine, which by the way are legal in CA.

As poster barney10 points out, the M1 Carbine is legal in California. What California does though is to limit "high capacity" magazines. That means that you can use a magazine with 10 rounds, but more than that can get you into trouble.

I recently went to a local gun store and saw a California legal AK47. And there are a LOT of "assault rifles" you can legally purchase.

Oh, there are some good folks speaking out...but the MSM, the DNC, and this administration just completely drown them out with their emotional chorus in an effort to advance their agenda...and to deflect the nation’s attention away from Obama’s abysmal record any way they can.

IMHO, Eric Holder deserves to be impeached and investigated himself for obstruction of justice.

I hate to spoil your fun, but not all “real” M1-carbines are legal in California, as I have had an extensive discussion with various regulatory authorities in California over a paratrooper M1 Carbine I inherited from my father-in-law. The State of California defines it as an assault rifle and requires it to be either demilled, confiscated, or sold to a specially licensed dealer, should I move to California. I even discussed with them changing the stock on the carbine.

A “real” M1 Carbine is a semi-automatic rifle and it can accept a “large (over 10 rounds)” detachable magazine, it has a bayonet mount, and it if is a paratrooper model it has both a folding stock and pistol grip. Under California law if a semi-automatic rifle has more than one of the above, it is an “California defined assault weapon” and banned from normal ownership.

The “AK’s” you are probably talking about at the gun store are probably MAK’s or other variants that are specifically designed for the California market and do not have bayonet mounts, or pistol grips, but have an “enlarged” thumb-hole stock that handles much like a pistol grip. At least that was my experience.

There are now, new manufactured and California-legal variations on the M1 Carbine that do not include a bayonet mount and have the traditional straight stock. Some even come with special 5 or 10 round magazines, so they are “legal.” If the home owner had a “real M1 carbine” he is in real trouble.

Not to worry. My M1 Carbine was legal when I bought it, and it is still legal.

And by the way, gun stores legally import full auto AK74s, yes AK74s, and make them California legal.

I see no conflict with making an AK47 California legal either.
