Is that even possible? I’m not sure you can court martial a retired officer, unless it happened while he was active.

As a Retired Field Grade officer I am still subject to Courts Martial for any crimes I commit even if those crimes were committed after Retirement and bring disgrace on the service.

He is still in the inactive reserve. If the Army wants a piece of him, he can get called up to active duty then tried by courts martial.

Since it is a crime under federal jurisdiction he can also be charged and tried in a federal court.
