Okay, according to this analysis, the ACLU might be engaged in a little hyperbole.

While S. 1235 had some very scary language in it, apparantly this one does not and applies only to foreign capture of noncombatants, but under the law of war.

Thanks for that. Why isn't this being discussed publicly?

The corporate media is doing their part by completely ignoring what is taking place regardless of the fact that the proposed legislation will have unprecedented constitutional implications no matter how it turns out.

After reading this I'm not sure how hyperbolic the ACLU really is being. Nasty legislation being snuck past us.
