Children of Illegal Immigrants Sue Florida Over State’s College Tuition Policy

MIAMI, Fla. (CBS Tampa) – Children of illegal immigrants living in Florida are suing the state for charging them out-of-state tuition.

Wendy Ruiz, a sophomore at Miami Dade College, is one of those behind the lawsuit.

She is paying $5,000 more than she technically has to, because her college insisted upon charging her out-of-state tuition when her parents were unable to produce legal immigration documents.

Here's an idea how about before filing a lawsuit at the courthouse you fill out the paperwork to be a CITIZEN!

Here’s an even more radical idea—Now that we know who (and presumably where) they are; how about arresting their illegal a$$e$ (along with those of their families) and DEPORTING them?

Since Wendy was born here and is a U.S. citizen, how's about we give her in-state tuition and deport her illegal alien parents? Sound like a plan?

If she isn't a legal resident of the country, she isn't a legal resident of the state, and so "technically" I think she should pay out-of-state tuition.

As a US citizen who pays tons of taxes, and who also had to pay full-boat out of state tuition for my kids, I don't think she should be in line in front of my kids for special tuition breaks. In fact, she should be thankful that she hasn't simply been deported for being here illegally.

Before deporting, bill her illegal parents for every govt service they have received since illegally settling here, including any Homestead exemption for their property

I'm not sure, but I think Florida is trying to take advantage of the common ruling that a student's residence is that of her parents'. It generally takes a year of independent living, not as a student, by a person before a state recognizes that person as eligible for in-state tuition.

In this case, her parents don't have legal residency in Florida, so she gets charged out-of-state tuition.

In FL, if the student is a minor, it is the residency of the parents (or whoever is paying) that is the determining factor.

Not just a ruling. It is written in the FL statutes (I believe). At least it is absolutely stated on the university websites as a requirement.

My point is, that no one who is not legally residing within the United States, either as a nation, or with proper residence permission, should not be considered a legal resident of a state.

Some will argue states' rights here, but this is one area where it shouldn't apply. Not only are all universities Federally supported (i.e., my non-FL taxes are involved), but in addition, we need a national immigration policy unless the states are highly separated and responsible for their own immigration and border policing.

Sorry... now that I read the article more carefully, I see she is an anchor baby citizen. In that case, Florida law is Florida law... tough. It won’t be the first time a legal definition tripped someone up. She can establish residency for a year by moving out of her parent’s home.

Also, the parents should get the boot, and we should initiate an end to the anchor-baby misinterpretation of the 14th, although it’s too late for her.
