I read another article that said he told the police officer that they got the slower guy. Yikes!!

Fine him. Jail him. Take his license away for a year or two. Beat him with a stick. Make him do public service at the medical examiner’s office, and sentence him to five years of driving a rebuilt Yugo when gets his license back. Better yet, make him ride the bus when he wants to go somewhere.

NO ONE EVER passes a field sobriety test ... don't ever take one

don't refuse .... ask if there are any legal consequences to taking the test

Remain polite and clearly state for the camera that you are not refusing but that you would like to have advice of counsel before taking the test

keep breathing deeply and let them either make the claim that you are refusing the test .. which you repeated claim that you are not .... and when they arrest you explain to counsel that you never refused but asked if there was a legal consequence to the test and when told there was asked for advice of counsel before taking any test.

If you remain cool and courteous you should walk

For people who are not from Albuquerque Paseo Del Norte is full Al Unser Jr’s and that is why I try to avoid it as much as possible. I was coming home from the airport Sunday and witnessed two idiots racing on Paseo. This past Friday two guys racing Mustangs caused a bad accident on I-40.

I commute on this section daily. My experience is that at earlier commute times, you get a couple of idiots, but most folks stay between 60-70 MPH. It's the non-commute times that folks really open up - I've been doing 70 and have been passed like I was sitting still (once by a cop, who was not on duty - called the city on him - no lights, no siren, no nothing but a white streak). I've witnessed donor cyclers riding wheelies at well over 70 mph.

Paseo is three lanes in each direction, and except for a big dog-leg, mostly straight.

I think he’s more embarrassed that he lost the race.

I would imagine that a professional race car driver (and alcoholic) clocked at 110 who blows a .16 (or whatever it was) would be just as safe as an average Joe going 70.

The report states the vehicles were traveling so fast and weaved at the last minute across lanes near the Coors off ramp, the other cars had to slam on their brakes.

Ya just can't make this stuff up.....

The Coors off ramp!?!?!?!?!

Knowing Albuquerque, he probably blew only slightly higher than the cops.

In that case I guess the thing to do is to just dismiss the case and wish him well.

Good thing I wasn’t asked the only time I was stopped (and I was stopped - in a lit church parking lot after a long drive and I couldn’t keep my eyes open). The whole police force in a small Texas town surrounded my P/U and skipped the stand-on-one-foot test and went right to the breathalizer test: Blew 0.00. They then said I could not stay there but had to park at the local convenience store lot. I said o.k. but was then awake enough to drive the remaining 30 miles.
