Commercial fishermen will no longer have their regulatory cases heard by Coast Guard Administrative Law Judges.
Instead, the National Oceanic and Atmospheric Administration announced that as of Thursday, Environmental Protection Agency ALJs will preside over all new fishing law enforcement cases.
This measure is being taken in response to an inquiry made by the Inspector General into complaints by commercial fishermen that NOAAs National Marine Fisheries Services regulatory system was being excessive with its penalties and actions.
Jerry Slaff, NOAA public affairs officer, said the EPA will provide judges for regulatory cases for the next two years. He said NOAA is still looking for a permanent solution to its law enforcement issue.

Could someone point me to the Article/Section # of the constitution where it states the EPA is part of the judicial branch?

Perhaps this action is merely a governmental attempt to make EPA look more 'important' by giving it more responsibility, so as to provide EPA some excuse for not being completely shut down, when the super-committe comes looking for budget cuts. (...Certainly they might well have reason to be concerned that their current dual 'mission' - that of scr*wing up America's energy supply, while simultaneously scr*wing over American businesses and private land owners - might be judged 'inadequate', by 'some', in that regard.)
