A problem with gaining access to those records is the fact that the State Department is currently under the control of Obama appointee, Secretary of State Hillary Rodham Clinton and US Immigration and Customs Enforcement (the successor agency to INS) is under the control of Obama appointee Janet Napolitano, Secretary of Homeland Security.

Why would he want to do that before any act of a state legislature has been passed and signed into law by a governor?

If anybody needs or wants to see any of those documents in advance of the 2012 election season, a congressional subpoena for them could have been/can be issued by any Republican Chair of a House of Representatives committee from January 3, 2011 onward.
