For those who are persuaded by this argument, our common law abhors restrictions on the free use of property, and any restrictions imposed by zoning, covenant, etc. are strictly construed to effect the intent of the restriction. If someone manages to wiggle out of a restriction, well, he has a right to the beneficial use of his property.
SO... it's OK to get a WAIVER as long as it benefits YOU, and even if it HARMS someone else ?
It's OK to get your wife on the TREE COMMISSION, because she could use her official post to cause a REZONING by changing the TREE footage requirements ?
This same 'attitude' is what got us OBAMA.
Let me ask you this: WHY did that couple so DESPERATELY want to build their new home on a narrow strip of land which wasn't originally zoned for it ???????
