It's a complete guarantee that it will be heard at the first level of appellate of review.

I don't think so. Appeal is guaranteed depending on the sentence that the court martial imposes. But since Lakin pled guilty to all but one of the charges, the additional punishment incurred from the missing movement conviction may not rise to the level of an automatic appeal.

Sheesh. You sound like a liberal on this thread. Those Democrats used the same nonsense in 2005 saying that President Bush presided over an illegal war due to wrong intel. We were beating the dems up for that. There were many soldiers who refused to go to war over it and when they went to jail we celebrated.

I know you are not a liberal that is for sure but you just sound like one tonight. Maybe you are tired.

I doubt it, they are going to get a nice plea agreement for him to go away quietly and possibly keep his retirement or stay out of jail. You don’t sentence a Lt Col with an MD to twenty years, it just doesn’t happen.

Yes I feel really sorry for Lakin. Somebody talked him into a bad idea. They are going to make an example of him to keep others from getting the same idea.

Yeah, he's like one of the suckers who listens to one of those goofballs who claims to have discovered a legal loophole that makes it possible to get out of paying taxes.

No. Even if we lived in a fantasy universe where the Birther arguments actually had some merit, the fact is that Lakin’s lawfully appointed superior officers, not Barack Obama personally, gave him the orders he chose to disobey.

No, I am not in the military. I was not born in this country but love it with all my heart. I just don’t know much at all about military justice. I read a lot, but legalese is tough to understand.

The usurper could have ended all of these court cases two years ago with a $10 bill.

Why on God's green earth would he ever want to end a spectacle that serves as such an embarrassment to his oppositions? If anything, his people are probably poking the Birther movement with a stick every time it shows signs of going into hibernation.

I believe that the maximum sentence Lakin is on the hook for is three and a half years. That and being cashiered and losing his pension. I don't know how much jail time he'll actually get but I'm sure there will be some. The cashiering and loss of pension is a given.

It seems like an unwinnable scenario. He has sacrificed EVERYTHING, for nothing. My heart goes out to him.

What this shows us that no one in power in our military has any cahonies. When you start grinding up good men the end is in sight. Recall that we hanged Germans for obeying illegal commands.
