Wait, HE was dismissed?!? That combined with 6 months and loss of all benefits it total C-R-A-P. You know if it was under any other administration, this would NEVER have gone this far. W and Clinton both would have brought forth the BC and be done with it in five minutes flat. Not happy with convincing Lakin to ruin his career, Red Steel now tries to convince Lakin to spend any money he has left over on worthless law suits...

Of course, since Lakin admitted he was wrong to disobey orders, and wrong not to deploy, he doesn’t seem TOO likely to believe the Internet Lawyers who want him to waste any savings he has on lawsuits, now that he has ‘standing’!

Good grief! Haven’t you Internet leeches hurt the man enough? A good lawyer did the best he could with a large can of worms and got him a lenient sentence. But now the Birther Cabal is dancing around, claiming Lakin has ‘standing’ - a term birthers don’t have a clue about - to sue Obama for Lakin’s own guilty plea! What do you ILs expect - the lawsuit will allow discovery, just like this court martial was supposed to give you?

Lakin acted the idiot and is paying a mild price after groveling in court. Find someone else’s life to try to destroy...

But he pled 'not guilty' to the specification charge number 1. And since Lakin has suffered injury he has standing.

There is no connection save in your hysterical imagination.

LTC Lakin was not crucified. He disobeyed lawful orders. He was court martialed for that. But in case your unaware of it, the practice of addressing disobedience to lawful orders via court martial predates LTC Lakin. He set no precedent in that regard.

If Congress repeals DADT and legislates that you can't discharge a homosexual service member, it will be a problem for you if you try to do so. It would be the exact same problem if LTC Lakin had never even been heard of. The problem is simple--if Congress makes it legal to be a homosexual in the military, its power to do so flows from the Constitution and is binding upon the military. So again, what do you propose the army should do?

How is the army to preclude open homosexuals serving when it is mandated to do so? How is the army to avoid legal ramifications if you try to discharge a serving homosexual when there is no longer a legal basis to do so? You're the one blustering about it, and I can see no option other than openly illegal defiance that does constitute rebellion against Constitutionally defined authority. So again, what is the army supposed to do if Congress repeals DADT?

He gets the same appeal rights for his case as anyone else in that situation.

By time until a more conservative congress and POTUS are in place. Get the truth out to the public about what is happening as events unfold and abuses occur; and they will. Get the public to wake up. Basically do a retrograde operation to inflict damage on the left until the offensive can be reassumed and any ridiculous “laws” overturned by more sensible leaders.

Never retreat...retrograde until the offense can be restarted. Will this happen...probably not. Too many persons like Lind holding commissions. Too many Admirals/Generals like Mullin in key positions.

But until that happens, the army will be under a legal obligation it has to fulfill (if Congress does repeal DADT). And the people struggling with how to do that aren’t sell outs.

To expand on my post, Lakin has standing in civil court, but just having standing is not enough to bring suit.

A scenario. If it was ever found that Obama was ineligible for presidential office. I don't know the particulars on how the suit would come about. It could possibly be for 'wrongful dismissal' by the Army without - just cause - because the government operated on a lie. The matter would have to be researched if he could sue with a reasonable chance of success...which would ultimately be decided by a court to proceed with the civil suit, but this would way down the road.

As for the moment, his case is now an automatic appeal to the first level of appellate review.

Yes they are, IF, like ADM Mullin they actively embrace it. Like I told you....buy time! Engage in retrograde operations.

Lind is a sell out because she could have allowed LTC Lakin an affirmative defense. She was either a willing or cowardly pawn of corrupt higher echelons. However, we have beaten this issue to death and will never agree on what was proper/ethical/moral (I don’t care about legalese) for the military judge to do.

There are a million ways to delay the onset of DADT until a more conservative congress and POTUS arrive. It will just take some creative actions by senior officers and the lower ranks. The Commandant of the Marines is not a sell out. I’m certain he will conduct retrograde operations to delay and inflict damage on the liberal agenda.

I do know one thing. I don’t want to see anyone sacrifice themselves the way Terry Lakin did. No one should openly fight this....use stealth and politics and the plain truth.

I have lost my confidence in the military justice system to properly protect the rights of the members of the armed services and maintain discipline. The system, in the wrong hands, has become draconian. Dr. Lakin cannot get a fair review.
