The Federal Judge in Virginia just threw out Obamacare. He ruled that it is Unconstitutional and used the commerce clause in his reasoning. Other judges who upheld Obamacare, also used the Commerce Clause to rule that Obamacare WAS Constitutional.
Of course, it is not yet dead, there are the expected appeals.
