With voters headed to the polls Tuesday to decide the fate of California's climate change law, regulators are pressing ahead with a key part of the statute that puts limits on how much the state's companies can pollute.
The California Air Resources Board today will unveil new rules and regulations for a cap-and-trade program. It will set a ceiling on the amount of carbon that refiners, power companies and major manufacturers can emit each year.
While details of the regulations aren't yet available, ARB officials have already indicated that they plan to take a pro-business approach. They will initially give companies pollution allowances for free, rather than selling them at auction.
"Because of the state of the economy, to go to a large auction quickly just isn't realistic," ARB Chairwoman Mary Nichols said in a legislative hearing earlier this month.
The cap-and-trade program essentially places a cap on the amount of carbon emitted by the state's 500 largest polluters. Companies that pollute less then their limit – to be set by the state – can sell their unused allowances to companies that pollute heavily, creating market incentives for the companies to reduce emissions voluntarily.
The cap-and-trade program is set to begin operating in January 2012. But it could be put on hold if Proposition 23 passes Tuesday.

I agree. And with the underlying premise that this is all based on having been destroyed, it’s utterly contemptible for them to push forward with Cap and Trade anyway.
Al Gore has about as much credibility these days as Pat Paulson did when he ran for president.
How many people work at the refineries? How many are union? How much do the companies pay in salary and benefits? How much does each facility generate in post tax revenue? How much will cap and tax cost the companies? How much would it cost to just close the refinery?
Run the numbers. If it is cheaper to close the refineries you close them.
Quick story. I worked for a manufacturing company back in the 90’s. In one of their plants, there was a cafeteria. About 20 people manned it. They were all union employees.
Well management was retooling a line and needed 2 people to come over from the cafeteria to the line. They refused. The union stepped in and told management that they had to hire two more people instead of pulling them from the cafeteria. Management said no.
So the union decided to file a grievance.
Well a couple of weeks later, several trucks showed up at the plants dock. In it were vending machines. The trucks sat there for a day or two. Management once again asked the union to reconsider and let the two people move over to the line. The union said no.
Over the weekend, the trucks unloaded the the vending machines, they were set up in the cafeteria, the cafeteria was closed and on Monday the plant fired 20 workers.
It was cheaper in the first place to have the machines. But the plant cared about its workers so it paid more to have bodies there.
California is playing a dangerous game that in the end might cost them billions.
Way to bankrupt your state Kalifornia. Why not just secede and go Marxist all the way. Bring every one into the Third World. Cap n’ Trade Tax everyone to a dibble stick agrarian culture.
The illegal alien problems will be solved. People will be streaming into Mexico for a better life.
Breathing is already deemed toxic by the EPA.

The California Air Resources Board sure is powerful.
All refineries shut down in Kalifornia and no oil, natural gas, gasoline or any of those dirty nasty carbon causing fuels are allowed in that state. They are not allowed to import anything that causes CO2 into their state. Completely green.
Yay! The greenies will have their wish.
Although they may get tired of it when they have to return to horses and there are horseapples all over.
They may not like bicycling 40 miles to work up and down mountains, or through gang neighborhoods. What do you want greenies, a brutal, wretched, retro-stone age lifestyle or do you want to endanger the planet?
Kind of a shame that they will go through all that based on a hoax…
The difference is that Pat Paulson was a comedian and Gore is a clown.
Pat Paulson was funny and Gore deserves jail-time for his foolish antics.
What you do is raise your rates. Then utilities make you and I pay for it. Then the state starts an investigation to find out why the refiners are gouging the utilities. And then some small fines are heaped on the refineries to save face. Then the refineries raise their rates. The utilities make you and I cover that too.
All is forgotten, while the public walks a little more bent over.
I actually brought this up to an Exec at Union 76 recently while at his home, they would never even consider such a thing, too afraid of negative publicity, bunch of wussies.
The sure fire way to end this Madness would be to simply use the Constitution:
All Petroleum companies should immediately demand ALL PAYMENTS FROM ANY GOVERNMENT AGENCY TO MADE IN GOLD AND SILVER COIN as defined in Article 1, section 10.
This would end this crap overnight, there ARE NO LAWS REQUIRING ANYONE OTHER THAN FINANCIAL INSTITUTIONS THAT ACCEPT FEDERAL DEPOSITS TO ACCEPT FEDERAL RESERVE NOTES OR CREDITS.
I agree. I still think they’re both comedians, perhaps not intentionally. ;^)
